EXECUTIVE OFFICE OF THE PRESIDENT after BUREAU OF THE BUDGET WASHINGTON, 25, D. C. APR 16 1945 My dear Mr. Latta: On April 12, 1945, you advised this office that H. R. 201, "For the relief of the Dempsey Industrial Furnace Corporation, " had been re- ceived at the White House, and requested reports and recommendations as to the approval of the bill. It is the purpose of the bill to pay the sum of $1,035, to the Dempsey Industrial Furnace Corporation, of Springfield, Massachusetts, said amount representing the cost to the corporation of furnishing salt as part of the equipment of a gas-fired salt bath type furnace supplied to the Naval Air Station, Pensacola, Florida, pursuant to a contract dated May 13, 1943. A facsimile of the enrolled enactment has been referred to the Navy Department, and its reply, recommending approval of the bill, is attached. It appears that the claimant misinterpreted the speci fications issued wi th the request for bids, due to the fact that it had never supplied the salt for furnaces of this type, and, therefore, the cost of furnishing the salt was not included by the claimant in submitting its bid. The cost of furnishing the salt was $1,035, and if this amount had been added to their bid ($5,807), they would still have been the lowest bidder. When the mis- interpretation was discovered by the claimant, it was urged by the Navy De- partment to purchase the salt with the understanding that the Department would recommend relief in the amount involved. Under the circumstances, and especially since the payment of the addi- - tional amount proposed by the bill would still put the claimant company in the place of lowest bi dder, I am authorized by the Director of the Bureau of the Budget to recommend that the bill be approved.
