C. 1/2 MAR 1 31946 My dear Mr. Latta: The Congress has enacted H.R. 2748, "For the relief of the Dubuque and Wisconsin Bridge Company." It is the purpose of the bill to pay the sum of $481.67 to the Dubuque and Wisconsin Bridge Company of Dubuque, Iowa, in settlement of all claims of the Company against the United States for toll charges for the use of their Eagle Point Bridge by a rural mail carrier for the period October 1, 1936, through June 30, 1944. It appears that the claimant company had a contract with the Post Office Department covering the cost of tolls for the passage of a rural carrier over the bridge owned by it at the rate of $60 per annum from October 1, 1936 to January 31, 1944, and at the rate of $100 per annum from February 1, 1944 to June 30, 1944; that the contract was canceled as of September 30, 1936, by direction of the General Accounting Office upon the ground that the Acts of March 23, 1906 (34 Stat. 84) and June 27, 1930 (46 Stat. 821) relieved the Federal Government of the payment of bridge tolls for rural letter carriers; that the Supreme Court, subsequent to this action by the Comptroller General, decided that the Government was not entitled to free bridge transportation for such carriers; that a new contract was thereupon negotiated with the claimant bridge company for payment of tolls effective July 1, 1944; and that the payment proposed by the bill represents the amount that should have been, but was not, received by the claimant company under the rates established by its contract for the period October 1, 1936 to June 30, 1944. A facsimile of the enrolled enactment has been referred to the War Department, the Post Office Department, and the General Accounting Office, and the ir replies, either recommending approval of the bill or inter- posing no objection to its approval, are attached.
