My dear Mr. Latta:
The Congress has enacted H. R. 4479, "For the relief of William E.
Robertson and Estelle Robertson."
The purpose of this bill is to pay the sum of $500 to William E.
Robertson, of Minneapolis, Minnesota, as compensation for property losses,
and personal injuries and expenses incurred as a result of an accident in-
volving an automobile owned and operated by him and an Army truck, on May
20, 1944, in Minneapolis, Minnesota; and to pay to Estelle Robertson, his
wife, the sum of $200 as compensation for personal injuries and expenses
incurred by her as a result of this same accident.
It appears that on May 20, 1944, an Army driver while using an Army
vehicle on a personal mission, was proceeding south on First Avenue in
Minneapolis. At the intersection of First Avenue with East 26th Street,
an arterial highway, the Army driver, in complete disregard of a stop sign,
proceeded into the intersection at a speed of about 40 miles per hour and
crashed into the Robertson automobile which had been proceeding in a westerly
direction along East 26th Street and was half-way across the intersection
when it was struck by the Army vehicle.
As a result of the accident, Mr. and Mrs. Robertson sustained minor in-
juries, none of which is of a permanent disability character. They incurred
medical and hospital expenses of $57 and a property damage loss to their
automobile of $50, the amount not covered by insurance. In addition to
these items, the bill proposes to award Mr. Robertson the sum of $393 repre-
senting loss of earnings over a period of three weeks. The bill proposes
to award Mrs. Robertson the sum of $200 for pain and suffering incident to
the injuries received by her in the accident.
A facsimile of the enrolled enactment has been referred to the War De-
partment, and its reply, interposing no objection to the approval of the
bill, is attached.
The War Department, in reporting on the bill when it was pending be
fore the Congress, expressed the view that the accident and resulting per-
sonal injuries and property damage sustained by the Robertsons were caused
solely by the negligence of the Army driver.
I am authorized by the Acting Director of the Bureau of the Budget to
recommend that the bill be approved.
