My dear Mr. Latta:
The Congress has enacted H. R. 4862, "For the relief of Walter R.
Newcomb, Senior, Corbin A. Newcomb, and Walter R. Newcomb, Junior."
It is the purpose of the bill to pay the sum of $791.30 to Walter R.
Newcomb, Senior, the sum of $500 to the legal guardian of Corbin A.
Newcomb, and the sum of $999.70 to the legal guardian of Walter R. Newcomb,
Junior, in settlement of their claim against the United States for per-
sonal injuries sustained by, and medical and hospital expenses incurred
on behalf of the two minor children, as a result of an explosion on
October 30, 1943, near the Woodward Army Air Field, Woodward, Oklahoma.
It appears that, on the date in question, Corbin A. Newcomb, aged
11, and Walter R. Newcomb, Junior, aged 15, sons of Walter R. Newcomb,
Senior, were walking along the road leading from the Woodward Army Air
Field to the State highway; that near the intersection of the two roads,
they found on the shoulder of the road an object identified as a "Charge,
spotting, assembly, MIAI"; that the boys did not know what the object was,
but picked it up and carried it about a mile and a half to their father's
farm; that they removed the cotter pin holding up the striker assembly
and attempted to remove the lid with a wrench; and that the lid came off,
and the powder ignited, injuring the two boys.
Corbin A. Newcomb sustained severe burns on the left arm from a
point three inches below the elbow to the shoulder and a small burn on
the left side of the head, from which he has, apparently, fully recovered.
Walter R. Newcomb, Junior, sustained severe first, second, and third degree
burns of the face, left ear, both arms, thorax, and abdomen, which, al-
though having healed, have left some permanent lack of use in the left
elbow and left arm.
The father of the boys incurred medical and hospital expenses on
account of their injuries in the amount of $791.30, for which reimburse-
ment is proposed by the bill. The bill also pays to the legal guardian
of the two boys the respective amounts hereinabove indicated by reason
of pain and suffering of the boys and permanent injuries sustained by
Walter R. Newcomb, Junior.
A facsimile of the enrolled enactment has been referred to the War
Department and the Department of Justice, and their replies, interposing
no objection to the approval of the bill, are attached.
