DRAFT 14D Attachment C -BECRET/SENSITIVE DRAFT TELEGRAM TO SWISS AMBASSADOR LANG IN TEHRAN 1. Please arrange, in cooperation with the German and Algerian Ambassadors (who are receiving similar instructions), to trans- mit the following urgent message as soon as possible to President Bani Sadr and Prime Minister Rajai. 2. BEGIN TEXT. The Government of the United States has noted with the gravest concern the announcement from Tehran that Iran is ending dis- cussion of arrangements for a peaceful resolution of the crisis between the U.S. and Iran and plans to put the hostages on trial. Iranian action in proceeding with a trial would have the following immediate and adverse consequences for Iran: (A) Iranian authorities will recall the message transmitted at the end of November 1979 that any public trial or governmental trial of U.S. personnel in Iran would result in the prompt interruption of Iranian commerce. That message remains valid. (B) The U.S. would not be bound by any of the proposals it has made in response to the resolution of the Majlis, including the pledge of non-intervention or the offer to unfreeze the assets. (C) The U.S. would again take the issue to the United Nations Security Council and other appropriate inter- national organizations to seek enforcement of the orders of the International Court of Justice and otherwise further to DECLASSIRED SBCRET/SENSITIVE Per; Rac Project ESDN; NLC- 6-31-9-5-6 BY.
