May Affect Nomination of
Wilkerson
WASHINGTON, April 8. (AP)-The
astonishing narrative before a senate
committee by the man who prose-
cuted Al Capone of the gangster's un-
der-cover workings is being given a
thorogoing over in congress.
Not only might the testimony

upon the nomination of Judge James
H. Wilkerson of Chicago to the circuit
court, but other ramifications with a
view of breaking gangland's power are
also being discussed.

Judge Wilkerson, in connection with

whose nomination Johnson was sum-
moned, sentenced Capone to 11 years
in the penitentiary. In so doing he
overthrew an agreement by Johnson,
upon which the prosecutor said he
consulted Attorney-General Mitchell,
to recommend a 2¹/²-year term if Ca-
pone would plead guilty. President
Hoover nominated Wilkerson as an
indorsement of his vigor.
Opposition Arises
Since, however, strong opposition to
the nominee has arisen from organ-
ized labor because of past decisions
of the jurist. It has been met by
support to Wilkerson by Chicago
anti-crime workers, some of whom
have charged that even this opposi-
tion was inspired by Capone in his
attempt to control Chicago public
offices.
Hearings on the nomination were
drawing to a close when it was de-
cided to call Johnson. The sub-com-
mittee considering the nomination is
expected to decide soon upon its re-
port, with the attitude of Chairman
Borah one of the deciding factors. He
has given no indication yet of his at-
titude.
Johnson's inside story of the gov-
ernment's long battle to put Capone
and his gang in jail held those who
heard his testimony fascinated,
"Arrogance" Causes Upset
He said the "unbelievable arro-
gance" of Capone in making the
terms of the agreement public, after
Wilkerson had first approved it, led

to the upset.
Most amazing was the prosecutor's
description of intimidation of wit-
nesses and of the profits reaped by
the gangsters.
