SECRET - 17 - such legislation, we should cite our unblemished safety record and enormous technical experience in an effort to persuade the Spanish that the probability of an incident is vanishingly remote, and that if one should occur, the overwhelming political and moral obligation such an event would impose on the U.S. Government would provide the best insurance possible that any just claims would be fully met. If the Spanish raise the question of guarantees covering nuclear weapons, we should take the position that such a guarantee would also require Congressional authorization. Prospects for obtaining such precedent-setting legislation are dim. In any event the same overwhelming political imperatives cited above would ensure prompt and full indemnification in the event of a weapon accident, as the Spanish know full well from their experience in the Palomares incident. Gibraltar If the Spanish raise the question of Gibraltar during the negotiations we should adhere firmly to our traditional position that this is a dispute between two friends of ours in which we must remain neutral.
