Director Helms
2:45 p. m. 10/27/69
Helms learned that Rogers was going to testify and took the liberty of
calling him. Helms testimony went off well he thought. The air war
didn't come up and he wasn't asked about sorties. The only thing that
did come up that he thought K and Rogers would be interested in was
that under the NSC act of 1947, the agency has certain authorities
but the language is not very strong on such things as XX para-military
activities. Helms told Rogers what the authorities were. Fulbright
said that the last three Administrations (included Nixon) had authorized
them, but this language was never intended to permit CIA to wage war.
Fulbright said that CIA can't tell him they are carrying on covert
operations and not waging way and the Administration can't ask for this.
K thanked Helms and said Rogers should certainly have been called.
Helms said for the rest of the testimony it was nuts and bolts and didn't
have any feeling that they were going to ask questions that Mitchell, et al
were worried that they might.
