TELCON Scotty Reston/Kissinger 5:12 p. m. 2/26/71 R: I have been sitting here today trying to puzzle in my mind when you claim executive privilege -- when you go public and when you don't. K: Personally? The Kalb thing? R: When you are on the record and when not. K: On the Kalb thing -- Let's take that first. I have never spoken on TV on substance or foreign policy and I had agreed to give a 10 minute account of what the report tries to cover. The one program that tried to cover substance and I was in the spot of SEXXXXXX seeming evasive on answering but I will never repeat it. R: You thought you were tricked? K: No, I think they felt they had the privilege to ask me what was in the report. I probably shouldn't have put myself in the position where ambiguity could arise. I shouldn't have. R: When I heardyouthis mornigg I couldn't believe my ears. K: I shouldn't have been done by a Presidential assitant and it will never happen again while I am here. R: I think there's confusion about this. I am interested in principle about this. Ehrlichman is another case --Hewill go to the Hill and answer questions and brief Republican members of Congress but not submit to questions by me particularly. I can see ? ? ? ? ? in a staff that gets more and more powerful but SO long as it sticks with executive privilege I can't quarrel with it. K: The general rule I have applied and will continue to apply -- I will talk about what my job entails and background of how something happens and what the report attempts to achieve but I cannot report ? ? ? ? ? . R: But for back ground you will. K: But I will try to stay within what I feel is a surrogate for the President on that and not an independent force. Since the Presicent can see as many as he wants. R: That's what I am trying to get straight. I think the WH is in trouble on this. I don't know what -- the last 2-3 weeks are ghastly. K: We haven't done much briefing here in the last 2-3 weeks.
