Telcon Mr. Kissinger AG Richardson 9/20/73; 3:30 p.m. R: J. T. Smith has just given me an account of his review of the transcript of your Executive Session testimony. He has been over it with Peter Rodman. There is one point I wanted to underscore -- national security wiretaps we really feel strongly that that out to come out. ought K: We have taken it out. R: I hope you will insist on that and not agree with the alternative redraft. K: I am not aware that there is an alternative redraft. I instructed my people to accept the changes that J. T. Smith recommended. R: J. T. recommended its being out entirely -- page 131. K: All right. What is your R: It was focussing on my letter to the Chairman. K: I know exactly what you are talking about. What do you object to ? R: Your language in the transcript confuses (?) judgment in the Halperin suit. K: I was not aware my people were offering compromises. R: I don't think they are offering J.T. and Rodman did work out language to soften the damage that was done. I am just saying, in my view, you should insist on having it out period. I was afraid you might go along with the rephrasing. K: I was not even given an alternative language. R: Maybe that was because Rodman considered the alternative was poor and didn't even bother you. K: If you don't hear from me in ten minutes you can assume that Smith's recommendation prevails.
