Dear Mr. President:
Pursuant to the provisions of "Section 103.101, Florida
Statutes, we are required, during the second week in January
each year a presidential preference primary is held, to
prepare a list of names of presidential candidates who are
generally advocated or recognized in news media throughout
the United States or in the State. Therefore, my list has
been prepared, published and submitted to the Presidential
Candidate Selection Committee which will make the final deter-
mination as to those names which will be printed on the ballot.
Your name was among those listed for consideration to the
Selection Committee.
Florida's election laws also provide that the names of
the candidates selected by the Selection Committee shall be
printed on the ballot unless an affidavit is submitted stating
without qualification that he is not now, and does not pres-
ently intend to become a candidate for president at the
upcoming nominating convention. An affidavit form is enclosed
for your convenience, if you wish to withdraw your name. It
will also be necessary for you to let us know the exact way
your name should be printed on the ballot.
A copy of Chapter 71-236, Laws of Florida, is enclosed.

Pursuant to the Florida law concerning the March 14
presidential preference primary, this office has established
a press clipping file which indicates that you are a possible
candidate for the presidential nomination. Enclosed you will
find a copy of a memorandum from Mrs. Dorothy Glisson, the
Director of our Division of Elections. This memorandum covers
the requirements of Florida law in the areas of filing reports
on receiving or spending of any monies or things of value
during the presidential preference primary in March of 1972.
As a candidate for president (also for vice president),
you do not have to file contribution reports for monies you
receive directly. However, Florida law requires that persons,
groups or committees receiving these items or spending monies
in your behalf must file the required documents with our
Division of Elections. I would suggest that you pass this
information along to your Florida organization so that they
may be aware of the legal requirements in this area. They
should also contact the Division of Elections to obtain the
proper reporting forms.
As an additional precaution, we are releasing copies of
this memorandum to the press so that it may receive full
publicity in order to alert campaign personnel of their
responsibilities under the law.

SUBJECT: Reports, Candidates for President and Vice President
In answer to your inquiry about the requirements to file
reports by candidates for President and Vice President, the
Attorney General ruled in an opinion 052-203 that -
"The applicability of the statute to candidates for political
office is limited to those candidates who are seeking nomination
or election to an office in the State of Florida. Since the
offices of President and Vice President of the United States are
not political offices in the State of Florida, candidates seeking
those offices do not come within the contemplation of Section 99.161,
Florida Statutes. "
However, since that opinion, Section (15) of 99.161 was adopted
and requires persons, groups or committees receiving or spending
any moneys or things of value in behalf of candidates for President
and Vice President to file a report. The report is required to
be filed forty-five days after the election; a copy to be sent
to all candidates in whose behalf the action was taken and to the
Chairman of the State Committee of the party with whom the candidate
is affiliated.
To comply with the spirit of the law, we have suggested to the
committees who have contacted us that they use the campaign deposit
slip and check forms prescribed by our office and to file the names
and addresses of their Treasurer and Depository.

Glisson Director, Division of Elections\nSUBJECT: Reports, Candidates for President and Vice President\nIn answer to your inquiry about the requirements to file\nreports by candidates for President and Vice President, the\nAttorney General ruled in an opinion 052-203 that -\n\"The applicability of the statute to candidates for political\noffice is limited to those candidates who are seeking nomination\nor election to an office in the State of Florida. Since the\noffices of President and Vice President of the United States are\nnot political offices in the State of Florida, candidates seeking\nthose offices do not come within the contemplation of Section 99.161,\nFlorida Statutes. \"\nHowever, since that opinion, Section (15) of 99.161 was adopted\nand requires persons, groups or committees receiving or spending\nany moneys or things of value in behalf of candidates for President\nand Vice President to file a report.
