3-19-9. Campaign Practices General and Special Elections Itemized Statements of Expenditures Filing. Within ten days after a general or special election. a candidate
participating therein shall file an itemized statement of expenditures ou forms prescribed and furnished by the Secretary of State. The itemized statement shall be subscribed and
sworn to by the candidate.
3-19-10. Campaign Practices -- General and Special Elections Itemized Statements -- Contents.
A The itemized statement of expenditures filed by each candidate after a general or special election shall set forth in detail each item showing the full and complete record of
the
candidate's expenditures of money, or other things of value and the cost thereof. including all promises to pay money or other things of value, as well as treats. presents or
favors which cost money or other things of value. either present or future. which were intended for the purpose of aiding. or that could have the tendency to aid, the success of the
candidate in the general or special election.
B. As used in this section. "itemized statement" means listing a class of like expenditures by each item within that class separately and not as one item. Each item of
printing small be set out separately and such advertisement in a newspaper, on radio, television or billboard shall be specifically set forth with the cost thereof.
C. The expenditures made for traveling and to hotels or motels for sleeping and eating accommodations shall not be included in the itemized statement of expenditures.

David Wilson, of your Office, has raised the question as to whether
the Vice President's September 12th one thousand dollar contribution
to the Finance Committee for the Re-election of the President (the
Committee) should have been included in his Fifteenth Day Report.
He is apparently of the view that this contribution might be construed
as includable in either Individual contribution" under SECTION A,
Part 1, or in Transfers out" under SECTION B, Part 10.
After carefully reviewing the Federal Election Campaign Act of 1971
(the Act) and the Manual of Regulations and Instructions (the Regula-
tions) promulgated by the General Accounting Office, I was of the
opinion that the Vice President's contribution should not be included
in his Fifteen Day Report of Receipts and Expenditures. In reaching
this conclusion, I tried to err on the side of caution that it should be
included if there were any doubt. For the reasons which I shall
outline below, only one conclusion seemed possible - that it should
not be included, and the Vice President was so advised and did not
include it on the advice of counsel.
First, the Vice President, in making this contribution, supplied
the Committee with the information required by the Act and the
Regulations as to full name, residence mailing address and prin-
cipal place of business. That information, along with the
contribution, was recorded by the Committee and reported to the
General Accounting Office in the Committee's Fifteen Day Report.
By this procedure the public, through records available at the
General Accounting Office, is able to obtain information as to
this contribution. In fact, the Star carried a story on the contri-
bution. That is all that is required and comports with the intent
and spirit of the Act and Regulations. Moreover, this contribution
by the Vice President as a candidate does not exceed the fifty

thousand dollar limitation imposed upon Presidential and Vice
Presidential candidates and, therefore, is within the limitations
of SECTION 203 of Title II of the Act as it amends 18 U.S.C. 608.
Second, the form developed by the General Accounting Office for
Presidential and Vice Presidential candidates in conformity with
the Act and its own Regulations does not in any way contemplate
that a candidate's contributions to a committee shall be reported
on that form. In fact, the Comptroller General has explicitly
notified candidates that it does not have responsibility with regard
to Title II (attached for your information is the Comptroller
General's notice in that regard). David's view that the Vice
President's contribution might conceivably be reportable under
SECTION A, Part 1, or under SECTION B, Part 10, simply
ignores the fact that SECTION A relates to "RECEIPTS", that is,
monies coming into the personal possession of a candidate.
Part 1, "Individual contributions", obviously refers to contribu-
tions made to the candidate by another person, and SECTION B
refers to "EXPENDITURES'. One would have to indulge in a
strained legal fiction inconsistent with other provisions of the
reporting form to construe SECTION B, Part 10, "Transfers out"
as contemplating the inconclusion of a personal, "out of pocket,
contribution as within its definition. Not having reported the
one thousand dollars as a receipt, which it was not, and reporting
it as an expenditure, would result in an imbalance in "Column A"
under SECTIONS A and B which should balance out (that is TOTAL
RECEIPTS" should equal "TOTAL EXPENDITURES', assuming no
cash balance in SECTION C). Rather than strain the form developed
by GAO and thereby indulge in the fiction, I conclude that the General
Accounting Office simply did not contemplate that Presidential and
Vice Presidential candidates should report this contribution on this
form, but expected the recipient committee to report it as a receipt
in its own filing, as the Committee has done in this case.
Finally, and perhaps most significant, if a candidate were required
to report his contribution in the manner which David suggests, there
would be important gift tax implications resulting from such a con-
struction. Let us assume that a candidate decided to make a ten

thousand dollar contribution and reported it in the fashion suggested
by David. He would then arguably be subject to the gift tax above
the three thousand dollar exclusion. On the other hand, if our con-
struction is correct, a candidate could give to various independent
committees in amounts of three thousand dollars or less, and thereby
properly avoid gift tax consequences. The implications of this are
important since the fifty thousand dollar limitation with regard to the
President or Vice President applies in the aggregate to personal
funds of the candidate and his immediate family which, under Dave's
construction, would be reportable by the candidate. I believe that
no such gift tax consequences were intended by the Act, the Regula-
tions or the form devised by the General Accounting Office; and for
these reasons, conclude that it would not be proper for a Presidential
or Vice Presidential candidate to include his personal, out of pocket,
contributions to a committee in his personal filing of Receipts and
Expenditures.

the Campaign Act of 1971.

It is our understanding that the Campaign Act requires this

Return Receipt re Michigan Ballot
Section 168. 711 of the Michigan Election Code requires that each
County Board of Election Commissioners in Michigan send by registered
mail, with return receipt demanded, a proof copy of the official
ballot to every candidate whose name appears thereon. If the candidate
desires to correct the ballot, he must return it to the County Clerk
with corrections noted within two days of receipt.
Although the printed form used by County Clerks in Michigan to comply
with this provision of Michigan state law is worded so that the candidate's
signature should appear on the return receipt, there is no legal require-
ment that the candidate must personally sign the receipt. Therefore,
in order to save the Vice President from the burden of signing each of
the receipts sent by the Clerks of every county in Michigan, I recommend
that you or one of his other assistants handle this matter for him. A
sample copy of how the return receipt should be signed is attached for
your information. Also attached is the form from the County Clerk of
Kalamazoo County which you had forwarded for our consideration.

to be filed pursuant to state election laws. At Tab A is an Affidavit

Columbia. If you will return the signed and notarized form to us, we
will file both it and the President's affidavit with the Board of Elections.
At Tab B is a Notice of Candidacy and Affidavit which is required by
Georgia state law. This executed form can be sent directly to:
