Requirements of the Federal
Election Campaign Act of 1971
This is to call to your attention the provisions of the Federal Election
Campaign Act of 1971 (which became effective on April 7) that require
every Presidential candidate to file with the Comptroller General a
detailed report of contributions received and expenditures made.
These reports are required four times a year and also on the 15th and
5th days preceding the date of any election, primary election or
convention in which the candidate is running. Negative reports must
be filed if the candidate neither receives contributions nor makes
expenditures during the reporting period.
To comply with the Act in the easiest manner and to assure that no
technical problems arise in this still unsettled area of the law, it is
recommended that you not personally accept any contributions or
make any personal expenditures. If this procedure is followed, all
of the numerous reports that you must file will be negative reports.
Given the fact that these reports will be publicly scrutinized, you
may wish to give some consideration at some time during the cam-
paign to having the record indicate that you have expended some of
your personal funds in the re-election campaign.
The new law further requires that each report be signed personally
by the candidate and verified by a notary public. The Comptroller
General has ruled that the candidate cannot authorize anyone to sign
the report for him. Therefore, we will be sending each of these
negative reports to you as they become due and suggest that Rose
Woods notarize them.

There may also be certain state disclosure reports requiring personal
signature. A list is currently being compiled and, at the appropriate
time, the necessary state forms will be sent to you in the same manner
as the federal forms.
NOTE: When the Congress realizes the enormous amount of paper
work they have created for themselves -- as well as for Presidential
campaigns -- they may very well ask themselves what in the hell
they've done, and seek legislative relief!

we should follow in the 20 states conducting primaries in 1972.
For reasons of affidavid or tradition, we have committed the President
to enter the following:

There are four states which have Presidential Preference
Primaries that directly affect the commitment of the delegates elected.
They are:
INDIANA

Results of the preferential primary are binding on
delegates for the first ballot.
NORTH CAROLINA
May 6
The effects of the preferential primary are binding
on the delegates for the first ballot. Further, any
candidate receiving 15% or more of the state's primary
vote receives a proportionate share of the delegates.
NEW MEXICO
June 6
The effect of the preferential primary is binding on
the delegates for the first ballot. Delegates shall be
allotted to the two top candidates in proportion to the
vote they received in the primary.

The effect of the preferential primary has been
construed in the past to bind the delegates for
three ballots. However, the recent Attorney
General's opinion seems to indicate that this is
a moral obligation only (this could make an
interesting fight at the convention).
RECOMMENDATION --- That we initiate a program for these states and
enter these primaries.
Five states elect pledged delegates slates. They are:

RECOMMENDATION -- That we work closely with each of these state
organizations, carefully select the delegates
and that the President sign off in the appro-
priate manner so as to guarantee pledged delegates
from these states.
Three states conduct primaries which are purely advisory
and have no binding effect on the delegates to the National Convention.
They are:

RECOMMENDATION That we do not enter any of these states, as it would
involve an unnecessary expense on our part with no
real benefit resulting.

copies of our regulations under both Title I and Title III
of the Federal Election Campaign Act of 1971, as well as
copies of the registration and reporting forms.
As you know, political committees supporting candidates
for the office of President and Vice President are required
to file a completed registration form with the Comptroller
General on or before April 17 (10 days after the effective
date of the Act). In addition, such committees and the
candidates themselves are required to make periodic and
pre-election reports of receipts and expenditures at
specified times.
To assist us in making a proper distribution of the
forms and regulations, as we are required to do under
the Act, we shall very much appreciate your furnishing us
with as complete a list as possible of political committees
supporting your candidacy. Our Office of Federal Elections
will supply the reporting materials direct to the committees
and they may reorder supplies as needed.

Dear Mr. Thompson:
In accordance with 11CFR 20. 9 and the provisions of the
booklet Questions and Answers published by the Office of
Federal Elections of the General Accounting Office, I here-
with submit questions pertaining to the requirements of the
Federal Election Campaign Act of 1971. Interpretive rulings
by the Comptroller General responsive to these questions would
be appreciated at the earliest possible date so that we can
comply to the fullest extent necessary with this new act.
1. Does the definition of "election" in Section 301
(a) (2) of the Act also include a state convention or caucus
held to select delegates to a national convention, in spite of
its explicit limitation to conventions or caucuses held to
"nominate a candidate", and require the filing of pre-election
reports for such state conventions or caucuses held to select
delegates?
2. Do pre-election reports for primaries by candidates
for nomination for election to the Office of President cover only
expenditures and contributions and other such items required
by Section 304 (b) directly related to the primary for which
the report is filed or should the pre-election reports for

primaries cover any expenditure made or contribution
received by the candidate anywhere (even in other primaries
for which reports are not yet due) in support of his campaign
for nomination for election?
3. If the pre-election reports for primaries by
candidates for nomination for election to the Office of President
cover only items directly relating to the state primary for
which the filing is made, must a candidate file a quarterly report
for each state that has already held a primary in which he was a
candidate if the quarterly report falls due before the national
convention is held?
4. If the answer to question 3 is yes, must the candidate
also file separate state quarterly reports after the national
convention is held, but before the general election? In other
words, how long is a candidate for Presidential nomination
required to continue to file reports relating to states after the
holding of the primary?
5. If separate reports for each state holding a primary
are required, is a candidate for nomination for election to the
Office of President also required to file a single comprehensive
quarterly report covering all expenditures and contributions in
every state where expenditures were made or contributions
received, including those states which do not hold primaries?

6. For pre-election reports before a general
election for President and quarterly reports after the national
convention, does the reporting period for the candidate begin
at the date that the candidate was nominated at the convention?
7. If the answer to question 6 is yes, is any report
required from a candidate for election to the Office of President
or any other candidate for nomination for election to that office
which covers the period between twelve days before the convention
and the date that the convention nominates a candidate?
