HALDEMAN FROM: GORDON STRACHAN SUBJECT: Gallup Surveys Mr. and Mrs. John Davies joined me for lunch in the White House Mess today with John Scali and Harry Dent. The discussion developed several matters of interest: 1) The Gallup trial heats testing the President against Humphrey Kennedy and McGovern revealed the following "approximate" figures: Nixon Humphrey Wallace N.O. G-Apr 22-23 46 35 12 7 Nixon Kennedy Wallace N.O. 46 35 14 5 Nixon McGovern Wallace N.O. 47 31 12 10 No release date has been set; 2) In the Wall Street Journal on Monday, May 1, there will be a lead article on Kennedy based on a survey conducted by "one of Gallup's affiliates.' The article will indisate that in spite of the very high awareness of Chappiquidick (95%) more people are forgiving Kennedy as time goes by. Women more easily forgive Kennedy for his actions than men. Gallup has been under extreme pressure not to conduct its Chappiquidick Anniversary poll this year. R. W. Apple and Tom Wicker have been especially insistent in trying to get Gallup not to conduct the poll this year; 3) Gallup is currently conducting an "image" study of all the Democratic candidates and President Nixon. Several of the questions will focus on -2- sincerity, truthfulness and experience. The results will be available about one month from now; 4) Davies believes that the amnesty question is analogous to bussing in the sense that very few (less than 15%) favor amnesty. Davies believes that it could become an important vote-getting issue for the President, especially in light of McGovern's position; 5) The President's basic approval level of around 50% puts him in a strong position for re-election. There has not been the erosion all other Presidents have suffered. The President's public relations operation has convinced the people that his views correspond with theirs thereby negating the importance of charisma; 6) Davies believes Gallup's unpublished research shows that the First Lady is probably his strongest untapped resource. She is more valuable than any Vice Presidential running mate. She has emerged after the Africa and China trips; 7) McGovern's support is weaker than the 15 point polition below the President indicates because his policy stands are so out of touch with the American people; 8) In discussions about the recent Hallup bombing questions, Scall made several suggestions to Davies regarding follow-up questions on the invasion, dominoe theory and secret missions. Davies seemed receptive and I will prepare questions for your review to send to him. 9) Davies expressed some concern about the political season and the increased pressure for information by Democrate and Republicans. I assured him that I would continue to be his only contact at the White House and that information would be kept very close. He seemed pleased and invited me to Princeton to meet George Gallup, Jr. and to examine their facilities. He asked me to say hello to Don Rumsfeld because he was George Gallup's classmate at Princeton and an old friend. ADMINISTRATIVELY CONFIDENTIAL April 26, 1972 MEMORANDUM FOR: H. R. HALDEMAN FROM: GORDON STRACHAN SUBJECT: Campaign Meetings Magruder proposes a new campaign strategy meeting to Mitchell in the memorandum attached at Tab A. Mitchell has approved the meeting and participants (Miller, Magruder, LaRue, Marik, Dailey, Teeter, Finkelstein). The first meeting will be this week on Key States. There is currently no agreement on Key States within the Committee to Re-Elect the President, as Magruder's memorandum attached at Tab B indicates. In light of the importance of getting Mitchell's views on Key States and campaign strategy for you, I asked Magruder if I could attend. Magruder said he was opposed and would not raise the question of my attendance with Mitchell. Magruder's reasons for objecting to my attending are: 1) The meeting must be kept small, 2) Marik can brief me afterwords on the decisions, and 3) The meeting should be purely campaign people without any White House Staff (hence, Malek's exclusion). You agreed last July to ask Mitchell if I could attend a much higher level meeting (that was eventually cancelled) on your behalf. To reassert in Magruder's mind the importance of keep- ing you fully informed, I believe it is an important matter of prénciple for you to intervene with Mitchell on my behalf. MITCHELL FROM: JEB S. MACRUDER CLIFF MILLER SUBJECT: Strategy Planning for the Campaign Campaign strategy is now developed in several areas: Campaign Strategy Group (Monday evening meetings). Brings together the thoughts of key White House personnel and those on the Re-Election Committee. Reviews and develops recommendations on broad strategy, with particular emphasis on advertising and the media. Strategy Planning Group (Saturday meetings). The directors responsible for pertinent campaign activities meet with each state chairman to develop a detailed strategy and operating plan for conducting the campaign in that state. The resulting recommenda- tions in the form of a state plan are presented to you for approval. November Group. Develops an advertising strategy consistent with the overall strategy of the campaign. Polling. Provides the basic research data for all of the strategy groups described above. In addition, the political division and the directors of the functional activities develop strategy relating to their own areas of responsibility, consistent with the overall campaign strategy. All of those groups perform a useful function in developing elements of the strategy for the campaign. However, they do not perform the essential function because: 1. There will be an election watch at 1701, which will rely on the wires and network coverage. The President's name is on the Massachusetts preferential ballot with Ashbrook and MdCloskey. The President is expected 8P to win easily. In Pennsylvania only delegates will be selected OC The Massachusetts polls close at 8,00 p.m. EST. Agree Disagree Comment COMMITTEE FOR THE RE-ELECTION OF THE PRESIDENT MEMORANDUM April 25, 1972 MEMORANDUM FOR THE HONORABLE JOHN N. MITCHELL THROUGH: JEB S. MAGRUDER SUBJECT: Election Night Here is a review of the key facts about tonight's primaries in Massachusetts and Pennsylvania and a description of our planned response. Massachusetts Both parties have preferential and delegate contests. Registered voters may not crossover. The polls are open until 8:00 p.m. Results may come in slowly because of wide use of paper ballots. The Secretary of State estimates that about 800,000 people will vote -- most of them on the Democratic side. The Democrats have twelve names on their ballot and 102 delegates will be elected. The delegates will be bound on the first Convention ballot to the candidate who wins the preferential. The latest Boston Globe poll shows McGovern with 43%, Muskie 19%, and Humphrey at 14%. In the Republican race, The President's name is on the preferential ballot along with Ashbrook's and McCloskey's. A light turnout, heavily in favor of The President, is expected. Thirty-four Republican delegates will be selected. Pennsylvania Both parties have delegate races, but only the Democrats have a preferential contest. Voters may not crossover. The polls are open until 8:00 p.m. Results should come in faster than Massachusetts since more machines are used. There are 2.8 million registered Depocrats, and turnout estimates range from 30 to 50 percent of this. The Democrats have five names on the ballot (Jackson, Humphrey, McGovern, and Wallace). They are selecting 137 delegaton. Muskie and McGovern have fielded full slates, while Humphrey -2- has only 128 delegates. The press predicts Humphrey will get most delegates, with Muskie a close second, and then McGovern far behind. In the preferential race Humphrey is expected to win his first primary. The order after that is in question: Muskie could finish second, but may fall behind both McGovern and Wallace. The preferential results have no bearing on the Convention delegates. On the Republican side there are 2.5 million registered Republicans. Those who vote will do so only for the 50 GOP delegates. Our Response We are preparing a statement for you in which we comment on Kennedy's obvious support for McGovern in Massachusetts. Senator Dole's statement will follow this same approach. Frank Dale's will emphasize the continued strong support for the President and his policies. We are also preparing comments for Arlen Specter, Senator Schweiker, Senator Brooke and Governor Sargent. HALDEMAN FROM: GORDON STRACHAN SUBJECT: Meeting with John Mitchell and Bob Teeter - April 17, 1972 You asked that the survey-strategy meeting with Bob Teeter be re-scheduled. A check with John Mitchell's secretary indicates that 3 P.M. today would be convenient. The question of whether Jeb Magruder and I should attend the meeting remains unanswered. Mitchell deferred to you when Magruder asked him. Set meeting at 3 P.M. with Mitchell and Teeter. Magruder and Strachan attend. Magruder and Strachan do not attend. Re-schedule meeting. Recent Teeter Memoranda on Wallace and the campaign theme are attached for review though you have already seen copies. Another matter which you may want to cover with Mitchell and Teeter is the question of Key States. The last time you formally addressed the question of Key States is June 23, 1971. Colson submitted a list of ten, which was accepted. The ten were California, Texas, New York, Pennsylvania, Ohio, Illinois, Missouri, Florida, Indiana and New Jersey. Mitchell has not directed Magruder to follow any set group of Key States, though several lists are used for a variety of purposes (scheduling, advertising, computer mapping, direct mail, etc.). The list which Chapin discussed with you in Canada is Teeter's informal assessment based on the campaign's first wave polls - 2 - and other polls Teeter has seen. The list is (a) California, Texas, New York, Ohio, and Illinois; (b) Pennsylvania, New Jersey, Wisconsin, Maryland, and Missomri; (c) Michigan, Connecticut, Oregon and Washington. Neither Teeter nor Magruder have covered the list with Mitchell. Magruder and others in the campaign are anxious for guidance from you and John Mitchell. Att. HALDEMAN FROM: GORDON STRACHAN SUBJECT: Charlie McWhorter McWhorter returned from Russia last week and called regarding the AT&T/Democratic debt charges by Senators Dole and Brock. McWhorter remains as mad as when you talked with him on March 17, 1972. McWhorter still blames the shortsightedness of White House staffers, principally Colson. McWhorter believes that because there is a stockholder's meeting this week, AT&T will have to issue a statement and "we will get what we deserve." First, Jeb Magruder talked with Evans and Novak on Friday, April 14 regarding the cost and construction problems encountered in San Diego. The story about the San Diego Convention appeared on the front page of the Los Angeles Times. Unfortunately "a White House source" is quoted as denying that the convention would move from San Diego to Miami. Magruder called Gerry Warren, Bob Finch, and Ken Clawsen and determined that they did not comment on the convention. Magruder and Miller believe Herb Klein may be the White House source". Magruder is trying to reach Klein. The second development concerns Bill Timmons. According to Magruder, Mitchell will want Timmons to take a leave of absence from the White House staff from mid-May through the convention in August to devote full time to the convention planning. Just before the China Trip you directed Dean to "get it done before it becomes moot." Nothing happened, so I drafted a memorandum for John Ehrlichman's signature to Dean on March 21st. Dean responded with an interim report indicating that the Acting General Counsel of IRS would begin working on some of the basic tax questions. All this results in indecision and delay. You told me in August that the President considered Dick Ritzel of Mudge Rose the best estate lawyer around. Ritzel's plan, after due deliberation with DeMarco, was submitted on December 23, 1971. It is John Dean's view that DeMarco and Ritzel are in a contest. The only loser is the President. It is my view that DeMarco's interim stop-gap Will proposal is the worst result possible because it will delay a decision until After November 7, 1972. If the President loses the election, the goals of the President's Papers and Estate Plan will be thwarted. The solution seems to be for you and Ehrlichman to make the decision whether the entire project is to be delayed until after the election. If that is the case, you should approve Dean's attached memorandum urging the President to execute a stop-gap Will tomorrow when he meets with DeMarco. Basis structure would be as follows: I. Declare California residency. A. This reaffirms the fact of California residency as heretofore evidenced by California voting registration. B. Claimed California residency has been the basis for no income tax liability under New York law since 1969. C. Declaration of New York residency in existing Will would subject the estate to a New York inheritance tax as well as a California inheritance tax on certain portions. II. Do not attempt to classify status of property as "separate", "quasi-community" or "community" in Will. Merely recite Will as intending to pass all property. III. Disposition of the entire estate, depending upon the testator's wishes as of now, can be by means of either of the following two options: A. Create usual California marital deduction type Will, with a marital trust and a residual trust. 1. Value of one-half husband's separate property and equivalent value of one-half interest in the quasi-community and community property passes to wife's trust, with income to her for her life with powers of inva- sion of corpus for her needs and with the balance, at her death, as she appoints in her Will. 2. Value of one-half husband's separate property and equivalent value of one-half interest in quasi- community and community property passes to the residual trust exclusively for charitable purposes. (Fund this trust with nonsensitive papers.) B. Create two trusts, substantially as in paragraph A above, but providing, however, that wife has no testamentary power over any portion of the marital trust, and at her death, income to the two daughters for their respective lives, and upon their respective deaths, to their children outright free of trust. Note: Gift Tax Consequences. No marital deduction allowed under these circumstances. Value of wife's share of community property will be a taxable gift to husband's estate, payable at husband's death. IV. A new executor should be named. Preferably a California resident to avoid bonding problems. Should also be someone familiar with Presidential Papers, as it will be necessary to segregate papers as between "sensitive" and "nonsensitive". (H. R. Haldeman still qualifies as a California resident under the Code, since he is temporarily away from the state in governmental service.) V. Terminate all existing joint tenancies.
