SUBJECT:
Update of Governor Wallace's Ballot Position
Attached is a chart indicating the Wallace ballot position as of August
2, 1972.
Changes since our report of July 19 are as follows:
Delaware--The AIP has held its state convention within the deadline set
forth in Delaware law. It has yet to certify a candidate for President.
Idaho --We have determined that the Conservative Party may, under state
election law, substitute Governor Wallace for its listed candidate, a
Mr. Steinbacker.
Illinois--The August 7th deadline for filing petitions for a new party
candidacy is approaching. There is some AIP activity to this end in
downstate Illinois. The AIP has not formally submitted petitions to
elections officials as yet. The state elections office feels that the
party will not be able to obtain the number of names necessary (25,000)
by the deadline.
Missouri--The July 31, 1972 deadline for obtaining a ballot position has
passed. The AIP plans to press its claim for ballot qualification under
state statute by bringing a court action. Their argument is that, by ob-
taining over 2% of the vote in two Congressional districts in the last
election, rather than statewide as is required by statute, the AIP should
be awarded an automatic ballot position in November.
Rhode Island--The AIP has submitted the requisite 500 signatures for bal-
lot position in November. It now only need certify a candidate.
Officials in both Utah and Alaska have indicated that they will allow the
AIP to certify a candidate for President within a reasonable time after
that party conducts a national nominating convention. Therefore, the dead-
lines set forth in previous status reports are not firm.

UPDATE OF GOVERNOR WALLACE'S FILING DEADLINES
Since my last report four more deadlines have passed in the states
of Arizona, Massachusetts, Nevada and New Hampshire. No action has
been taken in Massachusetts and Nevada. In Arizona the AIP is now
a recognized party and Governor Wallace can run as a candidate of
that party by nomination at their convention. The New Hampshire
deadline for certification of Governor Wallace as a candidate of
the AP has been extended to September 27th.

McG adviser Duffey, on CBS AM News, said McG was aware
of others in party needed to be heard
that it wasn't a spirit of
"arrogance" in the McG camp over the Platform
and that McG
hoped he would be "worthy" of respect from his opponents. Ex-
ADA Pres. Duffey said he'd learned "frustration" people have re:
the bureaucracy from the Wallace people. Wallace's aide Pelham
said he wished McG had made statement (that Duffey made moments
earlier re: worthiness of respect) a few weeks ago and followed it
to the letter. If they'd done so, the average man would have been
represented in the Platform. Pelham said average man has been
ignored by Dems' "exotic" stands and that the Platform doesn't
apply to millions.
But Pelham is frustrated because he says RN, fat cats, big
business and ITT are on the other side. So he'll go back to Ala.
and "tend to his business. 11 He'd have "no part" of a 3rd Party.
Gov. Edwards also said he "wouldn't" support another party's
nominee but "wouldn't feel comfortable" with McG, Edwards said
Wallace told him he would accept the VP nomination.
An Ala. delegate complained "The convention has been taken
over by McG what he wants he's going to get. But come Nov
,
what McG wants McG isn't going to get. 11
Wa llace aide Snider
charged the convention has been "stacked from the start. 11
ABC's
Bell said Wallace reportedly can't support the current Dem Platform.
Clip of Snider saying chances of a 3rd Party were "getting stronger
and stronger" followed. Wallace followed saying he hasn't said "at
all" that he's going to form a 3rd Party or leave the Dems. Bell
said phone calls have come in demanding Wallace make a 3rd party
run in view of the Platform rejection. This is support Wallace needs
to keep, said Bell, but Wallace won't make a 3rd Party run as he
can't raise the funds necessary, but also because he's in a position
inside the Dem. Party that he doesn't want to give up.
Wallace's legal adviser DeCarlo said if the Gov. asks his advice
on a 3rd party, "I'd tell him to stick in there and give them hell. 11 He
said Wallace could easily get on 28 ballots, and with little effort
could pick up 7-8 others
Snider admitted the Wallace campaign
was $250, 000 in debt but said he was confident Wallace backers would
cover this and contribute enough to keep a 3rd Party going til Nov.

Removal of Wallace S Name From the Ballot
Attached is a memorandum we have prepared for Bob Teeter to be
used for polling purposes. Part of the information contained
therein relates to the question you asked concerning removing
Wallace from the ballot in the four states where ballot position
had been obtained in his name by the American Independent Party
or associated political entities.
You will note that Schmitz has replaced Wallace as the American
Party candidate in Wisconsin. We have also learned that a simi-
lar substitution has been made by the Conservative Party of Kan-
sas and the American Party in Kentucky. Thus Wallace's name is
presently on the ballot only in the state of New Jersey.
In order for Schmitz to be substituted for Wallace in New Jersey,
state law requires that Wallace decline the American Party nomi-
nation in writing by September 28th. Based on what has transpired
in Kentucky, Kansas and Wisconsin and in view of the last minute
substitution of Schmitz and not Wallace for the Constitutional
Party's surrogate candidate in Pennsylvania (see accompanying mem-
orandum), we are of the view that a substitution of Schmitz's name
for that of Wallace may very likely also occur in New Jersey.
We will continue to monitor this situation and advise you if and
when such substitution does occur.

Based on information presently available, we anticipate that Con-
gressman Schmitz's name will be substituted for that of Governor
Wallace on the New Jersey ballot. In this connection, we note
that the AIP has recently certified Schmitz in California, Mary-
land and Ohio. Furthermore, the Constitutional Party, the pro-
Wallace group in Pennsylvania, substituted Schmitz's name, and
not that of Wallace, for its surrogate candidate Frank Gaydosh
a few hours before the local deadline.
Governor Wallace's name can only appear on the ballot in New York
if petitions in behalf of his candidacy containing the requisite
number of signatures (20,000) are filed by August 31st and if he
thereafter signs and acknowledges a certificate accepting the
Presidential nomination of the Courage Party. If Governor Wallace
declines to accept such nomination, that party may substitute
another candidate in his stead.

Based on information presently available, we anticipate that Con-
gressman Schmitz's name will be substituted for that of Governor
Wallace on the New Jersey ballot. In this connection, we note
that the AIP has recently certified Schmitz in California, Mary-
land and Ohio. Furthermore, the Constitutional Party, the pro-
Wallace group in Pennsylvania, substituted Schmitz's name, and
not that of Wallace, for its surrogate candidate Frank Gaydosh
a few hours before the local deadline.
Governor Wallace's name can only appear on the ballot in New York
11 petitions in behalf of his candidacy containing the requisite
number of signatures (20,000) are filed by August 31st and if he
thereafter signs and acknowledges a certificate accepting the
Presidential nomination of the Courage Party. If Governor Wallace
declines to accept such nomination, that party may substitute
another candidate in his stead.

November Ballot by State as of October 4, 1972
This memorandum is intended to up-date the analysis of the presidential
ballot in each state which we provided on September 12th. All filing
dates have past and the ballot is now firm in all but four states --
Arkansas, Florida, Rhode Island and Washington. Court tests or state
elections board decisions are still pending in these jurisdictions.
A new summary table indicating the ballot status of Representative
Schmitz and Dr. Spock in each state is attached at Tab 'A'.
It presently appears that Schmitz will not be on the ballot in eighteen
states and the District of Columbia. His name will definitely not be
listed in the District, Georgia, Hawaii, Indiana, Illinois, Maine,
Massachusetts, Missouri, Nebraska, Nevada, New York, South Dakota,
Texas, Vermont, West Virginia and Wyoming. He still has a remote
chance to win ballot position by court challenge in Arkansas and
Florida and by elections board appeal in Washington. Although the
AIP's prospects are better in the latter jurisdiction, Schmitz's
supporters will probably also fail to get their candidate listed in
the State of Washington.
Please note that the information previously supplied for Vermont was
erroneous. It now appears that Schmitz will not appear on the Vermont
ballot.
Governor Wallace has, as we previously had anticipated, been replaced
by Congressman Schmitz on the New Jersey ballot. This removes Wallace
as a candidate on the presidential ballot in all states. His name
will still appear through the party name in Connecticut (The George
Wallace Party), and, if the party does manage to attain ballot status,

in Rhode Island (The American Wallace Party). Finally, the Governor's
picture will appear on the Michigan ballot as part of the American
Independent Party symbol. (Kennedy and Roosevelt appear for the Demo-
crats and Lincoln for the Republicans.)
Dr. Spock will be listed as a presidential candidate in seven states:
California, Colorado, Idaho, Kentucky, New Jersey, Vermont and Wiscon-
sin. He has an outside chance of attaining ballot position in Washington.
Attached at Tab 'B' are revised pages intended for insertion in the
detailed full candidate ballot listing which we previously provided
for each state.

Since the memo of April 27, concerning Democratic delegate strength,
there have been delegations added from the following states:
1. South Carolina (Caucus)
2. Mississippi (Caucus)
3. Alabama (Primary)
4. District of Columbia (Primary)
5. Indiana (Primary)
6. Ohio (Primary)
7. Tennessee (Primary)
The results of the Ohio Primary are very close in several Congressional
Districts and will probably be challenged in some cases. The tentative
results shown in this report are those reported in The Washington Post
today.
The attached lists include the aforementioned additions and establish
the total tabulation as follows:

in Illinois
Higby received a report that a leader of the President's
campaign in Illinois was refusing to pay CRP personnel
until they delivered precinct lists to him, allegedly
for Don Rumsfeld's use.
Al Kaupinen, the CRP Regional Director for Illinois,
examined the facts and reported the following:
1) Bill McConkey was the Director of Field Operations,
whose name comes closest to the McGinty or McGooey who
was mentioned to Higby;
2) McConkey has collected six of the 35 volunteer
books in Illinois but has done SO with Kaupinen's
encouragement;
3) McConkey was hired from the RNC and is not
directly tied to Rumsfeld;
4) The difficulty Malek is having in obtaining com-
plete sets of volunteer lists from several states is
being met by choosing one man who is seeking a job in
the Second Term and requiring him to collect the lists.
McConkey has been selected on this basis to collect some
of the lists in Illinois;
5) All CRP personnel in Illinois have received
their final paycheck, so the delivery of campaign lists
to a particular individual is not a condition precedent
to payment.
