MEMORANDUM THE WHITE HOUSE WASHINGTON MEMORANDUM TO THE PRESIDENT FROM: PAT BUCHANAN MAY 26, 1969 " The President went too far, in our opinion, when he said that he will not seek racial, religious or geographical balance in making appointments to the Supreme Court. It is all very well to say that each possible nominee will be judged on his own qualifications, but one of the essentials for the Court as a whole is that it must have the confidence of minorities as well as the majority. A Court composed entirely of New Englanders or Midwesterners, or heavily overweighted with Protestants, Catholics or Jews, or a Court from which jurists of ethnic or racial minorities were excluded, would not command such confidence. # W. Post - 5/21 The above paragraph was the only editorial reservation the Washington Post had to the President's criteria on Court appointments. I would agree with the Post on this one. The President is right in ending the "Jewish seat" tradition and in dismissing outright any group's "claim" to a court seat. But the broadest representation on the High Court is essential to the broadest acceptance of controversial decisions. I would thus argue for consideration of an Italian- American to be named to the Supreme Court. The Italians have never had one of their own on the United States Supreme Court.
