The major stories of the day:
-- USSS agents refused to answer Ervin comm questions about tapes
on RN's orders barring them from testifying to "protective func-
tions, 11 but RN said he'd give procedural questions consideration.
Meanwhile RZ on ABC/NBC film (CBS noted) said tapes "of course"
would be considered presidential documents, but refused others
comment despite "heated" questioning (CBS). Led all nets, w/
Utley saying WH "acted firmly" to hold onto tapes. Mudd, in lead,
said WH invoked exec privilege in 1 part of the controversy re:
USSS testimony, while Rather noted Warren had "no comment" when
asked if privilege extended to tapes. Nets, which also noted Garment/
Buzhardt meeting w/RN, felt RZ's statement was best indication RN
would not turn tapes over to comm.
CBS' Osgood concluded show
by reading poem (over silent film, pics) re: statesmen and stars
taped in RN's offices
CBS noted GSA checked into JFK archives
and found 68 dictabelts and 125 magnetic tapes of conversations and
meetings during JFK Admin.
At Senate hearings, Ervin revealed RN's position and announced
comm. would write RN, asking for his cooperation in making avail-
able those tapes relevant to Watergate
No more than 12 tapes
involved, said Schorr, while NBC put # at 6-12 w/assurances they're
intact
NBC's Stern said comm. decided public opinion was better
method of obtaining tapes than subpoena, while ABC's Zimmerman
thought comm. felt RN had left an opening re: willingness to discuss
"procedures. 11
Kalmbach on CBS film (ABC noted) admitted in retrospect he realizes
fund-raising for defendants was improper, illegal and it's just as if
he's been "kicked in the stomach. 11 Kalmbach, tho, said Schorr,
"stuck to his position" he acted on his trust in WH aides, and on CBS
film admitted he thinks he assumed JDE was relaying message from
RN
In reports on all nets concentrating on transcript of JDE-
taped conversation w/Kalmbach, Ervin tried to "make the point" (NBC)
JDE was trying to protect himself by suggesting both men relied on
Dean's advice, an argument Kalmbach, who hadn't realized he was
being taped, called a "weak reed. 11 JDE also appeared to suggest
Kalmbach in grandjury testimony blame Dean.
