Finding it "hard to believe" that in over a year of "gate,
"WH hasn't gotten around to reviewing just about everything in its
possession which might be relevant, " Trib says St. Clair's
letter "seems almost calculated to taunt" Judiciary. Surely,
both St. Clair and RN "must realize now that course of events
is being determined not just by Judiciary, but by an increasingly
exasperated public opinion. 11 In "deliberately provoking" comm,
do they still hope "the captain's bridge can ride out the storm while
the rest of the ship founders beneath it?" Or do they want "to
provoke the comm itself into behavior SO rash as to discredit it in
eyes of public? While Waldie "seems to be stumbling into (the
latter) trap, 11 says Trib, most of comm and staff "have behaved well, 11
and the longer they maintain "dignity and composure, the more
certainly WH will have to recognize tactics of delay and evasion
won't work. "
Jeff Hart says concept of 3 separate but equal branches is not
a valid one for in the last resort, system's "1 of absolute Hill
supremacy" as hown by current impchmnt process. Twist, turn, and
delay as WH may, it knows it has no choice but to surrender to
Judiciary evidence requested. In this confrontation WH is hardly an
"equal branch" w/Comm. "restrained, if at all, only by Hill
sentiment. " In a mild collison w/ Pres, Hill can override his veto.
In a serious collison, Hill can impeach him. Hill can also refuse
to appropriate saleries and operating expenses for Exec. As in
legislated end to Cambodian bombing, Hill can even have the final
say in foreign policy. Hill even has the power to remove specific
legis from courts' jurisdiction. It can impeach judges, refuse to
pay their salaries, refuse to confirm them. Thus 3 branches are
only equal because in practice they've agreed to behave "as if" equal.
"By and large, Hill hasn't been obliged to flex, let alone use, its
Constnl muscles. 11 What we're seeing now is a breakdown of that
traditional restraint, says Hart.
