LISEN, et al, Defendants. No. 536, 524 MEMORANDUM OF OPINION. Overton, Lyman, Plumb & Vermille, by Carl J. Schuck, Attorneys for Plaintiffs; Merton A. Albee, Attorney for Defendants Lisen, et al; Haight, Trippet & Syvertson, and Ralph M. Arkush, Attorneys for Defendant Metropolitan Theophilus. This is an action for declaratory relief and injunction, involving a determination of the rights of two opposing factions of the membership of the Holy Transfiguration parish and church in Los Angeles, to the control and use of the property of the parish. (It will be referred to herein as "Transfiguration Parish" for the sake of brevity). It is composed of adherents to the Russian Orthodox faith and is a constituent part of the Russian Orthodox Greek Catholic Church. (The latter will be referred to herein as "The Church" for the sake of brevity.) Counsel assert this is a test case for determining the status of all the parishes, their property and their members, located in the United States, who do not recognize the authority of the present Patriarch in Moscow and his Holy Synod. All parties profess complete adherence to the faith and dogma of The Church and the court has no reason to believe other than that all of them are sincere in such profession. None of
