case is whether the Secretary of the Treasury is obligated to
disburse to local governmental units nearly $180 million in
General Revenue Sharing funds (representing 4.3% of the FY 1986
appropriation) which were sequestered under Gramm-Rudman-Hollings
before the revenue-sharing program was terminated by Congress.
As you may know, the Federal government has filed a notice of
appeal of the ruling by Judge Green. Please be assured that
the matter of whether this case should be appealed received the
closest scrutiny among the pertinent agencies, the Civil Division
at the Department of Justice, and the Office of the Solicitor
General. Wherever possible the Federal government strives to
resolve harmoniously conflicts with State and local governmental
units. There are, however, instances where the conflict is
unavoidable, especially when a significant amount of money is
at stake and the Justice Department's review of the law found
abundant support for the Secretary of the Treasury's action.

Dear John:
I want to apologize for the delay in responding to your letter on
legislation concerning the banking laws and recapitalizing the
Federal Savings and Loan Insurance Corporation (FSLIC). As you
know, because of the overriding need to recapitalize the FSLIC,
the President approved H.R. 27 on August 10.
We fully share your concerns about Title II of H.R. 27 and
opposed it during Congressional deliberations on the measure. In
our view, regulated financial institutions should be permitted to
engage in activities that are currently closed to them and thereby
compete more effectively with unregulated firms that engage in
similar activities without restriction. In this regard, the
Administration proposed in 1983 comprehensive legislation that
would have largely deregulated the non-banking activities of bank
and thrift holding companies (e.g., by permitting insurance
underwriting and brokering).
By restricting, instead of expanding, the activities in which
depository institutions may permissibly engage, Title II of
H.R. 27 is directly contrary to the Administration's policy.
When the President approved this legislation, he said that his
"willingness to sign this bill is based in part upon [a] statement
of congressional intent not to renew or extend the moratorium on
the granting of needed new authorities for banks beyond March 1,
1988. By that time, we hope that the Congress will present
the President with a comprehensive measure consistent with the
pro-competitive, pro-consumer legislation the Administration has
long sought.

I wanted to express my regrets at being unable to
attend the National Advisory Board meeting on Tuesday,
September 15. I understand you had a good group in
the Roosevelt Room. The President told me he enjoyed
his meeting with you.
The task you have taken on for the NRCC is an important
one. I am glad we have such loyal supporters like you
who are willing to do what is needed for a successful
election cycle in 1988. I have asked Guy to keep me
apprised of the Board's activities.
