As I noted in my memorandum to you of February 13, 1987, I do not have the authority to transfer any Board documents without the approval of the members of the Board. And, as I also mentioned in my memorandum, such coordination is made difficult, if not impossible, by the high level of classification that you gave to your request and the fact that two of the three Board members do not live in the area. Glenn Campbell, Chairman of the Board, has informed Ambassador Abshire that he needs specific authorization before he can make the requested information available. SCIARONI $65 COUNSEL SUBJECT: President's Intelligence Oversight Board Documents It has come to our attention that the President's Special Review Board has in its possession certain documents generated by the President's Intelligence Oversight Board (PIOB) that were transferred to you without the permission of the PIOB. Specifically, your letter of February 10, 1987 mentioned a memorandum from the PIOB to Admiral Poindexter dated April 8, 1986. It is our view that such documents have been made available to you improperly and in violation of relevant executive orders regarding the transfer and dissemination of classified information. Executive Order 12576 (December 1, 1986), provides in relevant part as follows: "The heads of Executive Agencies shall, to the extent permitted by law, provide the [Special Review] Board with such information as it may require for the purpose of carrying out its functions." (Emphasis added.) Thus, documents should be made available to the Special Review Board only to the extent and in the manner provided by law. In that regard, Executive Order 12356 on National Security Information (April 2, 1982) states in relevant part as follows: Section 4.1 General Restriction on access (d) Except as provided by directives issued by the President through the National Security Council, classified information originating in one agency may not be disseminated outside any other agency to which it has been made available without the consent of the originating agency. -2- The entity which transmitted the PIOB's document to the Special Review Board should have first gained the consent of the PIOB as the entity that created and classified the documents before they were released to any other party. We are aware of no authority that this requirement to consult the originating agency before releasing documents to any other entity has been waived. Thus, 1t is our belief that, other than those documents transmitted to you by the PIOB at the direction of the Chief of Staff to the President, you are improperly holding documents of the PIOB.
