The President today announced his intention to nominate Dorcas R.
Hardy to be Commissioner of Social Security. She would succeed
John A. Svahn.
Ms. Hardy has been serving as Assistant Secretary for Human
Development Services at the Department of Health and Human
Services. Previously, she was Associate Director of the Center for
Health Services at the University of Southern California in
1974-1981. Since 1983 she has been serving as Chairman of the
President's Task Force on Legal Equity for Women.
Ms. Hardy graduated from Connecticut College (B.A., 1968) and
Pepperdine University (M.B.A., 1976). She was born July 18, 1946
in Newark, New Jersey and now resides in Arlington, Virginia.

I have reviewed the SF-278 and Personal Data Statement filed by
Dorcas Hardy in connection with her prospective nomination to be
Commissioner of the Social Security Administration, and have no
objection from a legal perspective to proceeding with the
nomination.
The Office of Commissioner was established by Section 4 of
Reorganization Plan No. 1 of 1953, 42 U.S.C. § 3501 note.
Ms. Hardy has been serving since 1981 as the Assistant Secretary
of HHS for Human Development Services, a position for which she
was confirmed by the Senate.

Accordingly, assuming successful completion of all other
background checks, I recommend this nomination go forward.
Draft copies of Ms. Hardy's financial disclosure report will be
forwarded for preliminary review to the Office of Government
Ethics and the Department of Health and Human Services. The
original financial disclosure report will be forwarded for
certification when Ms. Hardy is formally nominated.

The President today announced his intention to appoint Jean Ruley
Kearns to be a Member of the Board for International Food and
Agricultural Development for a term of three years. She will
succeed Charles J. Marshall.
Dr. Kearns has been at the University of Arizona since 1970 where
she now serves as a Professor in the School of Agriculture. At the
University of Arizona she served as Assistant Executive
Vice-President (1978-1982), Division Chairman (1975-1976) and
Associate Professor (1965-1970). She served as Deputy Executive
Director (1983-1984) and Distinguished Scholar and Deputy Director
(1982-1983) of The Consortium for International Development.
She graduated from McNeese State University (B.S., 1957), the
University of Arizona (M.S., 1958) and Florida State University
(Ph.D., 1966). She is married and resides in Tucson, Arizona. She
was born December 5, 1934 in Bell City, Louisiana.

Appointment of Jean Kearns to the Board for
International Food and Agricultural Development
I have completed the review begun by Hugh Hewitt of the Personal
Data Statement submitted by Dr. Jean Kearns in connection with
her prospective appointment to the Board for International Food
and Agricultural Development. The President appoints seven
members to this Board, including at least four from univer-
sities. 22 U.S.C. $ 2220c. The Board participates in planning,
issuing recommendations, and monitoring efforts under 22 U.S.C.
§ 2220b to promote university programs on international
agricultural development, and to promote such development more
generally.
On December 30, 1985, Hugh sent a memorandum to the A.I.D.
General Counsel, alerting him to several consulting contracts
Dr. Kearns had with A.I.D. or A.I.D. grant recipients. Nancy
Frame from A.I.D. returned my call on February 11 with the
results of her review in response to Hugh's memorandum.
According to Frame, Dr. Kearn's situation was similar to that of
many Board members, and any perceived conflicts were the result
of the statutory requirement that membership on the Board be
drawn in part from potential recipient universities. Frame
advised that A.I.D. regularly issues 208 (b) waivers to deal with
this issue, and would do so in Dr. Kearns case. Frame also
noted that A.I.D. would advise Dr. Kearns to recuse herself from
participation in any grant review or other matter involving any
institution with which she had a consultancy or other financial
arrangement. I telephoned Kearns and advised her independently
of the need to do this.
In light of the foregoing, I have no objection to proceeding with
this appointment. There is scheduled a "retreat" for Board
members this weekend; it would be very helpful if Dr. Kearns
(who has been patient throughout this extended process) could be
appointed in time to participate.

Mr. Leibman is a partner in the firm of Sidley and Austin in
Chicago, Illinois. Previously, he was with the firm of Leibman,
Williams, Bennett, Baird & Minnon. He serves on the Executive
Board of the Georgetown University Center for Strategic and
International Studies and as a Director of the The Foreign Policy
Research Institute in Philadelphia.
He graduated from the University of Chicago (Ph.B., 1931; J.D.,
1933). He is married and resides in Chicago, Illinois. He was
born February 8, 1911 in Chicago.

Nomination of Morris Leibman to the
U.S. Institute of Peace Board of Directors
I have reviewed the Personal Data Statement submitted by Morris
Leibman in connection with his prospective nomination to the
Board of Directors of the U.S. Institute of Peace. In previous
memoranda I have reviewed the various requirements for
appointees to the Board. The Board must have no more than eight
members from the same political party. The Board currently has
seven Republicans, five Democrats, and one unknown (the
President of the National Defense University, a career military
officer serving ex officio). Leibman is a Democrat, so his
appointment will not violate the bipartisanship requirement.
Leibman's PDS presents no problems. He is a partner at Sidley
& Austin, on retired status. The firm is registered as a
foreign agent, but Leibman is not so registered, nor does he do
the work that has caused the firm to register. Assuming
successful completion of the background checks, I have no
objection to proceeding with this nomination. (Nominees to the
Peace Institute Board are not required to submit an SF-278.)
