SUBJECT:
Proposed Draft Letter from the President to
Dr. Joao Havelange, President of the Federa-
tion Internationale de Football Association
Bill Sittmann has requested clearance of the above-referenced
letter. The letter simply expresses the interest of the
U.S. in hosting the World Cup and urges careful considera-
tion of the U.S. Soccer Federation bid. The letter states
that "the organizing committee will receive all necessary
support." I do not think such a vague statement presents
any difficulties. Nor do I see any objections to the
President voicing support for the U.S. Soccer Federation
bid, since the Federation is the only U.S. organization
involved in this effort: there is no question of favoring
one domestic organization over another.

members of the Executive Committee of the Federation
Internationale de Football Association in connection with
your May 20 meeting to consider the award of the 1986
World Cup. As you know, the United States would be
honored to host this important event. I am convinced that
the United States would be a superb choice; the organizing
committee will receive all necessary support. I urge you
to consider carefully the detailed written presentation
which has been made by the United States Soccer Federation
1986 World Cup Organizing Committee and the oral presenta-
tion which will be made by that Committee during your
deliberations in Stockholm.

Richard Darman has requested clearance of the above-referenced
letters by noon today. The letters are identical, mutatis
mutandis, and state that the Administration will support
legislation to provide an exemption from federal antitrust
laws for local governments acting under authority of state
law and within their governmental capacity. The need for
such legislation was prompted by the Supreme Court's decision
last term in Community Communications V. City of Boulder.
I have no objections to the letters.

Dear Mr. President:
As a result of the Supreme Court's ruling in Community Communica-
tions Co., Inc. V. City of Boulder, local governmental activities
are now subject to scrutiny under the antitrust laws. At this
time, more than eighty cities are involved in antitrust
litigation in which the validity of basic local regulatory
activities such as zoning, licensing, franchising, and waste
disposal are challenged. These lawsuits and the threat of such
lawsuits have made the implementation of public policy difficult
and delayed the delivery of services to the public.
It is our view that Congress, in enacting the antitrust laws, did
not intend that activities of local governments would be covered
by the antitrust laws. For almost ninety years, the courts
treated municipalities as though they were immune from antitrust
challenge. In fact, it was not until 1978 that the gradual
erosion of municipal immunity began, culminating with the Court's
1982 ruling in the Boulder case that the activities of cities may
be subject to antitrust scrutiny unless those activities were
based on state law affirmatively authorizing the displacement of
competition with local regulation or monopoly public service.
Because of the devastating impact of Boulder ruling on local
autonomy, we are pursuing a legislative solution to this problem.
The Judiciary Committees in both the House and the Senate are
expected to take this matter up in the near future. It is our
hope that the Administration will provide support for our
efforts. We believe that legislation to ensure the ability of
cities to govern without fear of antitrust scrutiny is consistent
with the Administration's interest in returning authority to the
local level.

Presidential Response to Letter
from Jesse Jackson
On May 23, 1983, Jesse Jackson wrote the President to
protest the President's recent actions to replace certain
personnel at the Civil Rights Commission. Late Friday, June
3, Mel Bradley advised our office that he wanted to clear a
proposed Presidential reply by close of business. Richard
Hauser and I edited the draft reply, which had been prepared
by Mike Uhlmann, as indicated, and approved the reply as
edited. The original draft was incorrect in stating that
under the Administration bill the Commission would be an
independent agency, and that the Commissioners would no
longer serve at the pleasure of the President.

Letter to Allen R. Jones
for PROMOTE: America Campaign
Allen Jones of Michael Baybak and Company, Inc., a public
relations firm, is promoting a national campaign against
pessimism called "Promote: America." Jones asks business-
men to buy radio time and deliver up-beat editorial messages
on the economic recovery. Jones organized a pilot program
for his project in Chattanooga, and the Chattanooga radio
station manager received a positive letter from the President
on the program. Jones has now asked the President to send a
letter to 5 million businessmen asking them to participate
in Promote: America.
The Correspondence and Private Sector Initiatives offices
have collaborated on a response to Jones, not to the 5
million businessmen. The response stresses the optimistic
spirit of Americans, commends those participating in Promote:
America, and expresses hope for its success. I see no legal
objection to the letter. It is bland and does not commit
the President to anything. Jones will doubtless use the
letter to advance his project, but the Office of Private
Sector Initiatives has decided that Promote: America is
worthy of the President's support, and I see no reason to
second-guess that judgment. I also suspect that Jones
contemplates using Promote: America to help his P.R.
business, but nothing in the President's letter does SO.

Following the success of the Pete Wilson Campaign here in California, we
initiated a study to determine what could best be done to counter the
Misery Merchants and their constant barrage of bad news.
We selected Chattanooga, Tennessee as our test market.
We asked businessmen in Chattanooga to originate and air radio
editorials encouraging a constructive attitude towards the future, and
an aggressive defiance to the prophets of "doom & gloom." Each
businessman solicited was asked to pay for his own air time and to
record his own editorial.

The test was so successful that the two radio stations involved are
continuing the project as a regular sales program.
PROMOTE: America is a quite similar concept expanded to include 200
radio markets around the country. A brief prospectus is enclosed.
We believe PROMOTE: America will strengthen positive attitudes toward
your recovery program, Mr. President, and return us to the self-reliance
and productivity SO essential to the American character.

Draft Telegram to Governor Harris of Georgia
Richard Darman has asked for comments by 4:00 p.m. today on
a draft telegram, proposed by Carlton Turner, from the
President to Governor Harris of Georgia. Last week the
federal government sprayed paraquat on marijuana fields in
the Chattahoochee National Forest. The action prompted a
lawsuit, and Judge Charles Moye issued an injunction banning
further spraying in the area until a hearing could be held.
Although no further spraying is planned for the forest,
there are plans to spray in other states.
Governor Harris has supported the spraying, and been criti-
cized for it. Turner proposes to send a telegram to Harris
from the President expressing appreciation for his support.
I recommend advising against sending the telegram over the
President's signature. The question of the use of paraquat
for marijuana eradication is the subject of pending litiga-
tion, and the President should not gratuitously become
personally involved. If Turner believes a telegram is
necessary it should be over his signature.

Draft Telegram from President Reagan
Last Friday, August 12, 1983, the U.S. Forest Service and the
Drug Enforcement Administration sprayed the herbicide paraquat on
U.S. Forest Service land in Georgia where cannabis (marijuana)
was being cultivated. The sites were evaluated according to the
criteria set forth in the Environmental Impact Assessment, The
issue has become quite controversial because of the sensation-
alism triggered by the media and pro-drug organizations.
Paraquat is a legal herbicide used regularly on agricultural land
to control broad leaf weeds and to defoliate selected crops such
as soy beans. When sprayed on these agricultural lands there is
no issue made by the communities, media or pro-drug
organizations. But when we spray paraquat on a field of
cannabis, some individuals scream that they are being poisoned by
the Federal Government.
Governor Joe Frank Harris of Georgia has spoken strongly in favor
of our spraying program and has received some criticism. We need
his continued support, therefore, attached is a draft telegram
from the President to Governor Harris thanking him and
encouraging him to continue.
Please process this for clearance. The telegram will have the
greatest impact if it could be sent out today. Please let me
know if you have any questions.

Jimmy Stewart Request
By letter dated October 10 Jimmy Stewart asked the President
to serve on the Orme School Advisory Council.. The Orme
School is a highly-regarded private prep school in Mayer,
Arizona, which Stewart's son Ron attended. The purpose of
the Advisory Council is to promote a capital campaign by the
school. Those agreeing to serve on the Advisory Council
expressly permit their names to be listed on a letterhead
that will be used in the fundraising efforts.
Presidential Correspondence referred the matter to Kathy
Osborne, and Osborne sent it along to us. She advised that
the President thinks he should respond personally.
The President should not accept Stewart's invitation to
serve on the Advisory Council. Stewart explicitly
recognizes that the school simply wants to use the
President's name to promote its fundraising efforts. Such
activity is unfair to similarly situated schools and other
non-profit organizations that do not have Stewart's access
to the President, and is ultimately demeaning to the Office,
using it as a huckster's ploy. Agreeing to Stewart's
request would also associate the President with an
organization about which we know little and the activities
of which are beyond our control. The risk of embarrassment
is intolerably high. I have drafted a transmittal
memorandum for Osborne and, in light of the President's
expressed wishes, a proposed reply for his signature.

For some years, ever since our son Ron was at The Orme School,
I have been interested in Orme and have helped in whatever ways
I could. In addition to having been a member of the Honorary
Board of Trustees for some time, I agreed several years ago
to be Honorary Chairman of an effort to increase substantially
the School's endowment.
This Endowment Program was designed to be long range, but
within its time frame a short Capital Campaign has been planned
for which an Advisory Council of well known people is needed.
I have agreed to chairing the Advisory Council and I would
appreciate your serving with me.
Members of the Advisory Council would only be asked to lend
their name to the School's effort by allowing it to appear on
a letterhead with mine and on occasion signing approved letters
prepared by the School Development Office.
I hope you will agree with me that The Orme School has
rendered important service to youth over the years; now, with
American education at such a critical point, the School and its
philosophy are more essential than ever in the process of
restoring health to our educational system.
As a testamentary to Orme's outstanding quality, I enclose
a selection from a recent publication listing what it considers
the best American boarding schools. You will note that Orme
appears toward the bottom of the page under the cover sheet
with the old, long established schools.

The letter simply expresses the interest of the\nU.S. in hosting the World Cup and urges careful considera-\ntion of the U.S. Soccer Federation bid. The letter states\nthat \"the organizing committee will receive all necessary\nsupport.\" I do not think such a vague statement presents\nany difficulties. V. City of Boulder, local governmental activities\nare now subject to scrutiny under the antitrust laws. At this\ntime, more than eighty cities are involved in antitrust\nlitigation in which the validity of basic local regulatory\nactivities such as zoning, licensing, franchising, and waste\ndisposal are challenged. These lawsuits and the threat of such\nlawsuits have made the implementation of public policy difficult\nand delayed the delivery of services to the public.\nIt is our view that Congress, in enacting the antitrust laws, did\nnot intend that activities of local governments would be covered\nby the antitrust laws. For almost ninety years, the courts\ntreated municipalities as though they were immune from antitrust\nchallenge. In fact, it was not until 1978 that the gradual\nerosion of municipal immunity began, culminating with the Court's\n1982 ruling in the Boulder case that the activities of cities may\nbe subject to antitrust scrutiny unless those activities were\nbased on state law affirmatively authorizing the displacement of\ncompetition with local regulation or monopoly public service.\nBecause of the devastating impact of Boulder ruling on local\nautonomy, we are pursuing a legislative solution to this problem.\nThe Judiciary Committees in both the House and the Senate are\nexpected to take this matter up in the near future. It is our\nhope that the Administration will provide support for our\nefforts.
