ROBERTS 822 SUBJECT: Correspondence to James Baker from Margaret Czerwinski Concerning Her Son's Problems With Regard to the PATCO Strike Mrs. Margaret Czerwinski has written Mr. Baker about her son Bernard. Bernard Czerwinski, formerly an air traffic controller, was apparently fired during the PATCO strike. Mrs. Czerwinski contends that Bernard was not striking at the time but was instead on sick leave. I recommend referring the letter to the Federal Aviation Administration Chief Counsel and advising Mrs. Czerwinski that we have done SO. The White House obviously should not become involved in this particular case. A memorandum to the FAA Chief Counsel, and a brief reply to Mrs. Czerwinski are attached for your review and signature. He was on approved sech leave when the firings happened His supervesor did not call him to return to his job and when he did return 2 days later to the Groton new London tower at was closed and locked. VERSTANDI6'CC SUBJECT: NATIONAL GOVERNORS' ASSOCIATION REQUEST TO INTERVENE IN SUPREME COURT CASE The National Governors' Association has asked my office to set up a meeting with Rex Lee or his assistant Paul Bator and Glen Archer, head of Department of Justice's Tax Division, to discuss intervention in South Carolina V. Regan on behalf of the Government. This case involves tax- exempt bonds. This case started in the Supreme Court around February, 1983. The Supreme Court held a hearing this past Spring and decided that they had jurisdiction to hear this case. Because the case started in the Supreme Court, it appointed a Special Master to conduct the trial and pull together information. The Special Master will proceed with fact-finding over the summer and will hold a hearing in October. NGA would like to meet with the Department of Justice to ask for the following: 1. They want the Special Master to make the decision on intervention. 2. NGA. would like the Court to respond in five or six days rather than ten days because the Court is recessing soon. 3. The July issue of "Billboard" magazine is to be devoted totally to Mr. Jackson, and Mr. Jackson's public relations firm has asked Jim Coyne to obtain a letter from the President highlighting the recent White House event. The letter would appear, along with photographs of the event, in the "Billboard" issue. Coyne dutifully has recommended that such a letter be sent and has submitted a draft to Presidential Correspondence. I recognize that I am something of a VOX clamans in terris in this area, but enough is enough. The Office of Presidential Correspondence is not yet an adjunct of Michael Jackson's PR firm. "Billboard" can quite adequately cover the event by reproducing the award citation and/or reporting the President's remarks. (As you know, there is very little to report about Mr. Jackson's remarks.) ROBERTS Jgr SUBJECT: National Governors' Association Request to Intervene in Supreme Court Case The National Governors' Association (NGA) has asked Lee Verstandig's office to arrange a meeting between its representatives and the Solicitor General concerning South Carolina V. Regan, an original jurisdiction case pending before the Supreme Court. NGA wants to intervene in the case and would like to have the acquiescence of the United States in doing SO. The case concerns an obscure provision of the Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA), Pub. L. No. 97-248, requiring registration-required obligations of a state to be issued in registered rather than bearer form in order for the interest on such obligations to be exempt from Federal income taxes. South Carolina filed an original action alleging that this provision violated the Tenth Amendment and the doctrine of intergovernmental tax immunity. On February 22, 1984, the Court rejected the position of the United States that the suit was barred by the Anti-Injunction Act, 26 U.S.C. § 7421 (a), and accepted jurisdiction. No. 94 Orig., 52 U.S.L.W. 4232. The case is pending before a Special Master, as is customary in original jurisdiction cases., According to Tex Lezar, Verstandig's request has been overtaken by events. Lezar reports that the Solicitor General has already set up a meeting with the NGA, con- sistent with his policy of meeting with any responsible group concerning pending cases. Jocelyn White of Verstandig's office called on this matter this morning, and I advised her that it was my understanding that the desired meeting had been arranged directly by NGA with the Solicitor General. I further advised her that her office should have no further involvement, and that it was generally best to have groups with requests such as that of NGA contact the Justice Department directly, without White House intervention. Hair, Executive Director of the National Wildlife Feder- ation, on May 25, 1984. Hair presented the President with a copy of A Season of Spoils: The Story of the Reagan Adminis- tration's Attack on the Environment, and, according to Hair, the President said: "I'll have to read this book. Pantheon Paperbacks, publishers of the book in question, highlighted the quotation in its recent advertisement in the Post's "Book World" section. The use of the quotation violates our policy of not approving any use of the President's name in a manner that could be construed as an endorsement of a commercial product or enterprise. We should so advise Pantheon, with a copy to the Post, which ran the advertisement. I do not think we could do anything if Pantheon ignores our letter, as they may do. As the ad in question suggests, Pantheon is not in tune with the policies of the Administration. Nonetheless, it does not hurt to ask. A draft for your signature is attached. It is established White House policy not to approve any use of the President's name in a manner that suggests or could be construed as an endorsement of a commercial product or enterprise. Jay D. Hair, executive director of the National Wildlife Federation, met with Reagan for 35 minutes Thursday in a session arranged by Environmental Protection Agency Administrator William D. Ruckelshaus. Reagan was concerned about "continuing problems" in winning support among environmentalists, Hair quoted Ruckelshaus as saying. Hair gave Reagan a copy of "A Season of Spoils: The Story of the Reagan Administration's Attack on the Environment," by Jonathan Lash, an attorney for the Natural Resources Defense Council, and Katherine Gillman and David Sheridan. "I'll have to read this book," Hair quoted the president as saying. The book describes the actions of officials "with no respect for the public interest or their responsibility to enforce the law," Hair said. Hair did not win another promise he sought, for the president to give a major speech on his own environmental views. Hair said he told Reagan that one reason the polls show public distrust of him on environmental questions was, "You haven't talked to anybody in public about your views on the environment. He said, 'I'll admit I haven't spoken out on that as often as I should have." The federation has long been the largest and most conservative of the "Group of Ten," the major environmental lobbies in Washington. Many of its 4.1 million members and supporters are fishermen and hunters. In 1980, the federation says, its members voted 2-1 for Reagan. Hair said he recounted to the president one story in the book, of Bob Burnett, a New Mexico federation member who discovered oil drilling in a wilderness area by rig without a permit, and how Burnett said later his vote for Reagan was "the biggest mistake I ever made in my life." The president, according to Hair, commented, "I just don't understand why things like that happen." Lash's book chronicles the story of James Watt, the former secretary of the interior who favored development of energy resources, and of Anne Burford, the former EPA administrator determined to reduce government regulation. Hair said he met Watt twice and never met Mrs. Burford, but now, along with other environmentalists, enjoys frequent access to Ruckelshaus and Watt's successor, William Clark.
