SUBJECT:
S.J. Res. 336 -- "A Time of
Remembrance for Victims of Terrorism"
Richard Darman has asked for comments on the above-
referenced enrolled resolution by September 25. The joint
resolution, which passed both Houses by voice vote, condemns
terrorism and designates October 23, 1984, as "A Time of
Remembrance" for all victims of terrorism throughout the
world. That day is the first anniversary of the Beirut
truck bombing in which 241 Americans were killed. The
enrolled resolution is somewhat unusual in that it calls
upon Americans to wear a purple ribbon that day as a symbol
of "patriotism, dignity, loyalty, and martyrdom." It also
authorizes and requests the President to issue a proclama-
tion that the flag fly at half staff.
I have reviewed the resolution and have no objection to its
approval. The half staff provision is inconsistent with the
Flag Code, but obviously Congress can supersede the general
provisions of that Code in any particular instance if it so
desires. I also do not approve of ad hoc displays such as
the wearing of purple ribbons, but that of course is no
basis for disapproval of the resolution.

Discussion
S.J.Res. 336 proclaims October 23, 1984, the one-year anniversary
of the killing of two-hundred and forty-one United States
servicemen in Beirut, Lebanon, as "A Time of Remembrance" for all
victims of terrorism throughout the world. The enrolled
resolution urges all Americans to wear a purple ribbon, "a symbol
of patriotism, dignity, loyalty, and martyrdom" and to reflect on
the sacrifices so many have made defending the ideals of peace
and freedom.
Finally, S.J.Res. 336 authorizes and requests the President to
issue a proclamation calling upon agencies and departments of the
United States, as well as other interested organizations, groups,
and individuals, to fly the United States flag at half mast as a
symbol of hope for peace and freedom around the world.
The enrolled resolution passed the House and Senate by voice
vote. A draft proclamation will be forwarded for your

To proclaim October 23, 1984, as "A Time of Remembrance" for all victims of
terrorism throughout the world.
Whereas the problem of terrorism has become an international
concern that knows no boundaries-religious, racial, political, or
national;
Whereas thousands of men, women, and children have died at the
hands of terrorists in nations around the world, and today terror-
ism continues to claim the lives of many peace-loving individuals;
Whereas October 23, 1983, is the date on which the largest number
of Americans were killed in a single act of terrorism-the bomb-
ing of the United States compound in Beirut, Lebanon, in which
two hundred and forty-one United States servicemen lost their
lives;
Whereas many of these victims died defending ideals of peace and
freedom; and
Whereas it is appropriate to honor all victims of terrorism, and in
America to console the families of victims, and to cherish the
freedom that their sacrifices make possible for all Americans:
Now, therefore, be it
Resolved by the Senate and House of Representatives of the United
States of America in Congress assembled, That October 23, 1984, be
proclaimed as "A Time of Remembrance", to urge all Americans to
take time to reflect on the sacrifices that have been made in the
pursuit of peace and freedom, and to promote active participation by
the American people through the wearing of a purple ribbon, a
symbol of patriotism, dignity, loyalty, and martyrdom. The Presi-
dent is authorized and requested to issue a proclamation calling
upon the departments and agencies of the United States and inter-
ested organizations, groups, and individuals to fly United States
flags at half staff throughout the world in the hope that the desire
for peace and freedom take firm root in every person and every
nation.

The resolution designates October as "National Quality
Month," authorizing and requesting the President to issue an
appropriate proclamation. The resolution stresses the
importance of quality in America's economic leadership. OMB
and Commerce recommend approval of the resolution, which
passed both Houses by voice vote. I have reviewed the
memorandum for the President prepared by OMB Assistant
Director for Legislative Reference James M. Frey, and the
resolution itself, and have no objections.

of torture by foreign governments.

Discussion
In response to a campaign against torture initiated by Amnesty
International, H. J. Res. 605 reaffirms the policy of the United
States to oppose the practice of torture by foreign governments
through public and private diplomacy and, when appropriate,
through the enactment and implementation of laws which reinforce
the United States policies with respect to torture.
In particular the enrolled resolution:
-- requests the President to (a) instruct the Permanent
Representative of the United States to the United Nations
to continue to raise the issue of torture and (b) involve
the United States in the formulation of international
standards and implementing mechanisms, particularly the
draft Convention Against Torture and other Cruel, Inhuman
or Degrading Treatment or Punishment;

-- requests the Secretary of State to issue formal
instructions to U.S. embassy personnel to (a) investigate
allegations of torture and to report the results of such
investigations to the Assistant Secretary of State for
Human Rights and Humanitarian Affairs, (b) report on
efforts being made to combat torture in countries where it
is regularly practiced, (c) meet with human rights
monitoring groups in order to gather information, and (d)
follow individual cases of torture and when feasible, to
send observers to trials where the accused is believed to
have been tortured;
-- directs the Secretary of Commerce to vigorously enforce
current restrictions on the export of crime control
equipment; and
-- requires foreign personnel enrolled in U.S. - furnished law
enforcement and military training programs to be given
human rights instruction.
As the Department of State notes in its views letters, H.J.Res.
605, which reflects changes recommended by the Administration, is
"...a useful reaffirmation of present human rights policy.' It
passed the House and Senate by voice vote.

H.J. Res. 605 -- U.S. Policy
in Opposition to Torture
Richard Darman has asked for comments on the above-
referenced enrolled resolution by 3:00 p.m. today. This
resolution would express the policy of the United States in
opposition to torture. It would request the President to
direct our U.N. permanent representative to continue to
raise the issue of torture, and involve the United States in
formulating international standards against torture. The
resolution would also request the Secretary of State to
instruct our ambassadors to report on incidents of torture
and meet with groups active in opposing torture (such as
Amnesty International, a prime mover behind the bill).
Finally, the resolution would direct the Secretary of
Commerce to continue to enforce existing restrictions on the
export of crime control equipment, and would provide that
law enforcement training for foreign personnel furnished by
the U.S. include pertinent training in human rights.
The resolution passed both Houses by voice vote. OMB,
State, NSC, Defense, and Commerce recommend approval. The
resolution is mildly objectionable as an interference in the
Executive's conduct of foreign relations, but State notes
that, substantively, the resolution reflects current Adminis-
tration policy. Accordingly, I see no reason to interpose
an objection.

Discussion
S.J. Res. 260, which passed both Houses by voice vote,
designates November 11 through 17, 1984, as "National Blood
Pressure Awareness Week," and requests the President to issue a
proclamation calling upon the people of the United States to
observe the week with appropriate ceremonies and activities.
The designated week was selected by the sponsor to coincide with
the annual meeting of the American Heart Association in Miami,
Florida.
The resolution states that diseases resulting from high blood
pressure (hypertension) cause needless death and illness, which
can be reduced by early discovery and treatment through blood
pressure screening. It points out that 60 million Americans
have high blood pressure, which is a major factor in strokes and
stroke-related deaths, as well as heart attacks and related
deaths. S.J. Res. 260 states that 29 million workdays,
representing $2 billion in earnings, are lost each year because
of cardiovascular diseases, which are directly related to
hypertension.

The resolution attributes the 30% reduction in mortality between
1970 and 1980 for stroke, hypertension heart disease, and other
cardiovascular system disease in part to increased public
awareness and better control of blood pressure, and states that
increased blood pressure screening will identify greater numbers
of Americans at risk and encourage them to seek treatment to
control the condition.
In Senate floor remarks on S.J. Res. 260, Senator Quayle stated
that he was sponsoring the resolution in order to focus public
attention on the problem of high blood pressure, and urged all
Americans to take advantage of the many opportunities for blood-
pressure testing and education.
An appropriate proclamation will be forwarded to the White House
for issuance in a timely manner.

Whereas diseases resulting from hypertension cause needless mor-
tality and morbidity which can be reduced if hypertension is
discovered through blood pressure screening;
Whereas sixty million Americans are hypertensive;
Whereas hypertension is a major factor in five hundred thousand
strokes and one hundred and seventy-five thousand stroke-related
deaths annually as well as more than one million five hundred
thousand heart attacks and five hundred and sixty-seven thou-
sand heart attack-related deaths annually;
Whereas twenty-nine million workdays, representing $2,000,000,000
in earnings, are lost each year because of cardiovascular diseases;
Whereas the risk of the major cardiovascular diseases is directly
related to hypertension and even mild elevation in blood pressure
may result in substantial risk of illness;
Whereas much of the 30 per centum reduction in mortality between
1970 and 1980 for stroke, hypertension heart disease and other
cardiovascular system disease can be partially attributed to in-
creased awareness and better control of blood pressure; and
Whereas increased blood pressure screening will identify greater
numbers of Americans at risk for hypertension-related cardiovas-
cular disease and encourage these Americans to seek treatment to
control their blood pressure: Now, therefore, be it
Resolved by the Senate and House of Representatives of the United
States of America in Congress assembled, That the week beginning
on November 11, 1984, is hereby designated as "National Blood
Pressure Awareness Week", and the President is authorized and
requested to issue a proclamation calling upon the people of the
United States to observe such week with appropriate ceremonies
and activities.

The resolution is designed to increase public awareness of the
work performed by medical transcriptionists and to focus
attention on the shortage of trained personnel in this field.
Medical transcriptionists transcribe medical dictation detailing
a patient's health care during illness or after an injury. They
are indispensable assistants to physicians and surgeons, since
complete and accurate medical records are vitally important to
quality health care.
An appropriate proclamation will be drafted and forwarded to the
White House for issuance in a timely manner.

Background
The various Indian allotment acts which were enacted around the
turn of the century, provided that Indians would be individually
allotted portions of their tribal lands. The situation
engendered by these allotment acts, especially the General
Allotment Act of 1887, has resulted in the problem of
"fractionated heirship," which occurs when heirs of allotment
owners receive an undivided interest in the allotment. Over
successive generations, ownership of allotments can pass to
hundreds of individuals resulting in either numerous small tracts
of land, or in numerous owners of a single tract. In either
case, it is difficult, if not impossible, for any of the heirs to
derive economic benefit from the land. The Indian Land Consoli-
dation Act (ILCA) was enacted in January 1983 to ameliorate this
problem. Specifically, IL CA allows tribes to (1) consolidate

their tribal land holdings; (2) eliminate certain undivided
fractionated interests in trust or restricted lands; and
(3) adopt tribal codes of descent restricting inheritance of
Indian lands to Indians. As enacted by the Congress, portions of
ILCA's text were inadvertantly garbled and are in need of
technical correction.
The Enrolled Bill
H.J.Res. 158 corrects the above-noted printing errors and
clarifies and amends some of the more restrictive provisions of
IL CA so that the tribes have sufficient authority to address and
correct their particular fractionated heirship problems. In its
enrolled bill letter, the Department of the Interior provides a
detailed accounting of these amendments.
In its congressional testimony, the Department of the Interior
recommended enactment of H.J.Res. 158, because the corrections
and modifications it would make in ILCA will facilitate the use
of that Act in resolving the problem of fractionated heirship.
H. J. Res. 158 passed both Houses of Congress by voice vote.
