Board member Alfred Tisch of Hamilton City moved the Board's action, citing CRLA's "constant harassment of agriculture." The motion was seconded by Paul Ames of Indio. Dr. Francisco Bravo cast the lone dissenting vote, saying that, in his opionion, the Board was venturing into matters outside its proper sphere of activity. A copy of the Board's motion will also be sent to Frank Carlucci, acting director of the OEO, in Washington, D.C. Prior to the action, Board president Allan Grant of Berkeley read aloud a copy of a letter sent to Governor Reagan by Charles A. Rummel, a. retired attorney for the California Farm Bureau Federation. In recommending that the Governor veto the OEO grant, Rummel charged that CRLA ignores its limitations as a charitable organization exempt from state franchise tax, which would bar it from taking political action. He claimed that CRLA lobbies bills in the California state legislature. Rummel also wrote that CRLA's 37-member Board of Trustees meets seldom and gives little attention to setting up policies of the operation. "They are simply overwhelmed and overridden by a staff of 40 attorneys, their Washington legal director, and a budget of $1,800,000 per year," the letter said. There is absolutely no ques- tion in my mind that this type of Federal program does not re- sult in advantage to the poor. If we weren't so busy practicing law ourselves, I am sure that we could examine our activities for the year in such fashion as to put C.R.L.A.'s five attorneys in Modesto to shame. Also it is to commend you for the steps you have taken in connection with discontinuing it. I write because I am concerned about what seems to me discrimination against those of us who are in the middle income group. In one of California Teachers Association's publications, that appeared perhaps 3. year ago, this subject was discussed. Unfortunately I do not have the magazine, but because it was the report of-an interview I think it was in "The Valuator". I do not remember the name of the person who had been interviewed but she was a woman who had just prior to that been named head of the law department in one of our California universities. She stated that it is the middle income group which is not getting adequate legal service. From my own experience, from what I hear, from what I observe, and from just reasoning, I am sure that this is true. As I see it, to continue the program to aid the poor at the expense of the middle income group would be discrimination of great magnitude. Apparently you feel as I do. I cannot see that it is better to take my tax money and have it given to others for legal fees while I do without legal service that I need for myself. I feel that those who want to continue the program should be required to explain why they feel that it is better for those who receive the legal assistance and thus better for society than it would be to allow me to pay for legal services that I have to sacrifice. I would like to give an example. The government or some agency sets a figure of income as being the minimum that is needed for living for a family. Let us say the Plgure is $5000.00. Any one with an income of $5000.00 or less gets by without paying taxes or is subsidized in one way or another. The neighbor next door has an income of $5001. and this man pays taxes and has no subsidizing. This man ends up with a lower income then the first. Is it morally right to take Prom one to give to another without the one working for that which he or she is given? It would seem to me that the time to out back is here. As Chairman of the local Bar Association's Com- mittee which is in charge of this area, for the past two years, I have become extremely concerned with the 0 philosophy and the operation of this type of legal evdeavor in California. In this regard, the local Bar Association voted by an overwhelming majority approximately two years ago to withdraw all support from this type of program in our County, and to work toward a program that would give a greater measure of service to the indigent, along with a higher professional standing than has been evident under the current administration. a It has been the feeling of our Bar Association that the philosophy is wrong, in that the indigent per- son is not allowed the privilege of choosing his own attorney, but is forced to subscribe to the services of only a single law firm in town, being the firm which is supported by Federal funds. My personal experience with this organization as a school administrator has lead me to the conclusion that its activities have in too many cases gone far beyond the original intent of pro- tecting the legal rights of the poor. While no one can argue that all citizens must have equal protection under the law, I find it difficult to resolve that goal with the vicious and sometimes personal attack which I and the school district I serve underwent at the hands of the C.R.L.A. office here in Santa Rosa when C.R.L.A. attacked the constitutionality of the school's dress code. It appeared to me and to others involved that the C.R.L.A. attorneys with whom we had come into contact were political radicals bent upon using their positions, financed by our tax money, to carry out their own personal social crusades. I sincerely hope that President Nixon will support you in this courageous move. I continue to feel that you are doing an exceptional job as Governor of our state.
