Gentlemen:
I beg to acknowledge receipt of your
letter of April first and copies of letters annexed
thereto.
I think it will be more beneficial to
have the tests suggested by Dr. Thompson made, and
any information which my invesgitation can furnish
I will be only too glad to obtain.
So that there will be no misunderstanding
between us, I shall repeat in substance the contents
of my letter of March fourteenth with regard to the
position of the American Mutual Liability Insurance
Co. relative to their right to disclaim liability in
the event of a judgment being obtained by the plain-
tiff in the pending suit. Any action taken by me or
any of their agents in connection with the defense
to this suit shall not be a waiver of the company's
right to disclaim liability under its policy should
they desire to avail themselves of that privilege at
any time.
I hope to be able to send you a copy of
the order discontinuing the suit against Mr. Roeder
personally, within a day or two.
