ATTENTION: Mr. Markley
Gentlemen:
We hand you herewith summons and complaint in a
suit in the amount of $15,000.00 instituted by Theodore Kuser,
administrator of the estate of Helen Kuser, deceased, against
Arthur Roeder, the president of our corporation. The papers were
served Saturday, September 19th and you will note there is a limit
of 20 days from date of service in which to file answer. This is
really a part of the same suit brought against us in July by the
same complainent, which the Aetna Life Insurance Company is now
defending on behalf of the corporation.
It is understood between the Aetna Life Insurance
Company and ourselves that while the Insurance Company is willing
to handle this action in conjunction with the defence of the former
suit that their liability under the policy extends only to the
corporation and that should a separate judgement be rendered against
Arthur Roeder as an individual that the Insurance Company will be
under no obligation to pay such judgement.
