Dear Mr. Roeder,
I have your letter of the 3rd inst. If you are willing
to proceed with the negotiations for the settlement regardless
of whether the Aetna will make any contribution thereto, I would
suggest that you give Mr. McGlynn authority to make a definite
offer to Mr. Kalisch. This can be done either through me or by
direct communication with Mr. McGlynn if you prefer.
The suggestion which Mr. McGlynn made to me was that
we should tell Mr. Kalisch that we would pay $10,000. in settle-
ment of the three cases and that if he did not see fit to ac-
cept it we would try them. If this meets with your approval
and you will so advise me, we can immediately take this step
without waiting for word from the Insurance Company. It is
not probable that the Aetna Insurance Company will make any con-
tribution if this course is adopted but it seems to me that we
cannot wait indefinitely for them if we wish to settle the cases.
