Dear Mr. Roeder,
Mr. McGlynn called me on the telephone today and told
me that Mr. Kalisch had advised him that he was having diffi-
culty in inducing his clients to accept the settlement of
$13,000. The cause of the difficulty as stated by Mr. Kalisch
is that Dr. Knef asserts that he has a large claim for services
rendered and his clients fear that if they settle Dr. Knef will
recover a large judgment against them.
Mr. Kalisch's proposition to Mr. McGlynn was that we
should retain $1,000. of the amount to be paid in settlement
and endeavor to settle Dr. Knef's claim against his clients for
that sum and that we should agree that if Dr. Knef refuses to
accept this sum in settlement and recovers a larger sum against
his clients then we would pay the larger sum.
As stated to you over the telephone this morning I
told Mr. McGlynn that we would have nothing whatever to do with
any such arrangement; that we would pay Dr. Knef nothing; that
we would not raise our offer of settlement and that if the offer
were not accepted within a reasonable time we would withdraw it
