Gentlemen:
Att'n Mr. M. Kohn
We are in receipt of your letter of June 30th, returning the
Summons and Complaint in an action instituted in the New Jersey Supreme
Court, by Katherine Schaub against this corporation.
We note that you decline to accept the defence of this action,
even though the defence has been accepted by another insurance company
covering any possible liability which may have occured during the life
of their policy.
The time, at which the condition claimed in the Summons and
Complaint was contracted, is one that must be determined by the jury in
case the issues involved ever come to trial, and since our insurance
policies with you were in force during a portion of the time Miss Schaub
worked for us, we feel that we cannot release you from your obligations
should judgment be rendered against us.
However, we shall carry on the
defence of the suit without your valued assistance with the hope that we
may successfully resist the demands of the plaintiff.
