Dear Dr. Lind:
Our attorneys advise that at a preliminary
hearing before the Vice Chancellor in Newark yesterday,
relative to the evidence admissible at our hearing on January
12th, it was the Vice Chancellor's opinion that it will not be
necessary to have any out of town witnesses present on that
date.
It seems that there is a point at law to be
settled in these cases before the evidence will be taken, and the
Vice Chancellor's opinion is that January 12th, will be devoted
to this phase of the cases. The Vice Chancellor has set aside
only one day in January, and in the event that the cases are
continued in the Court of Equity it probably will be a matter of
months before the expert testimony will be required.
In view of these circumstances I would suggest that
you carry out the plans for your trip to Washington, disregard-
ing any possibility of coming to New York at the present time.
As you realize the courts act at their pleasure in
these matters, and it is a little bit difficult to tell at this
time when evidence such as you ar e able to give will be required,
but just as soon as we have anything definite we will communicate
with you. In the meantime should you be in the City I trust
that you will give us & call.
