FREDERIC J. FAULKS LINDABURY, DEPUE & FAULKS J. EDWARD ASHMEAD JOSIAH STRYKER JOHN W. BISHOP, JR. PRUDENTIAL BUILDING TELEPHONE WALTER D. BARKER MULBERRY 1755 JAMES E. M.TAMS BURTIS S. HORNER 763 BROAD STREET, NEWARK, N.J. ALAN W. CARRICK EDWARD P. O'NEILL,JR. March 8, 1928. RECEIVED RE: FREYER VS. U.S. RADIUM CORP. #3486-LDF MAR 9 1000 A. B. Lee, President, U. S. Radium Corporation, 535 Pearl St., New York City. Dear Mr. Lee, I am enclosing herewith copy of statement of facts which Mr. Berry asked us to agree to. I have not yet re- ceived the views of either Mr. Markley or Mr. Smith but I do not see how we can agree to any such statement. Of course, if Mr. Berry wishes to amend his complaint incorporating all those facts in his bill, we might move to strike it and thus raise the legal questions involved but I do not think it would be safe to make even a qualified agreement to the facts stated in the stipulation. Yours very truly, JS/EAS Enc.
