Dear Mr. Lee,
I am enclosing herewith copy of statement of facts
which Mr. Berry asked us to agree to. I have not yet re-
ceived the views of either Mr. Markley or Mr. Smith but I do
not see how we can agree to any such statement. Of course,
if Mr. Berry wishes to amend his complaint incorporating all
those facts in his bill, we might move to strike it and thus
raise the legal questions involved but I do not think it
would be safe to make even a qualified agreement to the facts
stated in the stipulation.
