March 12,1928. Dr. Herbert McCoy, Harper Plaza Hotel, 5129 Harper Ave. Chicago, Ill. Dear Dr. MeCoy: We have had quite a time getting an answer from our attorneys as to whether you would be needed at the trial beginning April and, and since the question of an agreement of facts with the apposing attorney is still not settled, our own lawyers can give no definite answor. Therefore we wired you as per attached copy of telegram. As we understand it your plans call for a short visit in Florida, and probably you will be there around April 2nd, and if it becomes necessary to have you at the trial we can communicate with you and have you run un from Florida or some other convenient point betwoen there and California. We regret vory much that we have been unable to give you anything definite on this, but it is one of those problems that it is difficult to get an answer on, and then when you get the answer the chances are that it is wrong.
