Re: Freyer vs. U.S.Radium Corp.#3486-LDF
Dear Mr. Stryker:
Answering your letter of March 12th:
It seems to me that both Doctors McCoy and
Schlundt have made it fairly clear in their comments on
Dr. Drinker's article, and their reports which we have had
from them, that they did not consider that our material was
dangerous prior to the year 1924. Neither of them are willing
to accept Dr. Drinker's report as conclusive proof that
danger existed, although as we understand it each of them
considers that Dr. Drinker's analysis sounded a warning of
possible danger.
I suppose the only thing to do is to have these
gentlemen come on to the trial a day or so in advance so that
the attorneys may check with them first hand these various
points. Mr. Barker has talked with all these experts and has
interpreted to our attorneys their position, but of course there
is always the possibility that something vital for or against our
position may be brought out when the attorneys have actual con-
tact with the experts.
This whole question should be thoroughly discuss-
ed at our first meeting with Messrs. Markley and Smith which we
hope will be at an early date.
