That the United States Radium Corporation, by i ts officers and agents, wrote to Dr. Drinker, who had informed the Radium Corporation that, because of its misrepresentation of him, he was going to publish his report without the consent of the United States Radium Corporation, that he was acting contrary to the usual custom of doctors and expert witnesses retained by a corporation to make an investigation, in publishing a report which might be used by plaintiffs in litigation against the corpora- tion and would injure the business generally of the United States Radium Corporation, and requesting that he re-consider his de- cision to publish. 36, That Dr. Drinker published his report in Volume 7 No. 8, August 1925 issue of the Journal of Industrial Hygiene. * 37. That in June 1925, when Dr. Cecil K. Drinker was demanding that his report be made public, the United States Radium Corporation, by its officers and agents, sought the assistance of a Dr. Frederick B. Flinn. 38. That Dr. Frederick B. Flinn began his work for the radium corporation by first getting in touch with Dr. Cecil K. Drinker, by the 3 following communications: " COLUMBIA UNIVERSITY COLLEGE OF PHYSICIANS AND SURGHONS 437 West 59th Street, New York DEPARTMENT OF PUBLIC HEALTH ADMINISTRATION June 1 1925 Dr. C. C. Drinker Havard Medical School, Boston, Mass. My dear Dr. Drinker The U. S. Radium Corporation showed me your reports of June 3 and 27th, If you sent them a report of your animal experiments I did not see it, The report of June 3 was about twenty seven pages long and contained your recommendations as to the shop as well as your observations. It also contained bibli- ography. They are having a. copy made for me. There was no way for me to judge whether this re- port was your complete report or not except for the signature. 10
