Dear Dr. Schlundt:
Yesterday we had a conference with our lawyers in
regard to the law suits pending.
The Judge has set aside April 25,26 and 27, to continue
the hearing of these cases, and our attorneys have finally outlined a
mare or less definite program to be followed, unless a change is necessitat-
ed on account of the pleasure of the Judge, which I present to you for your
consideration.
The matter of physical examination consisting primarily
of a gamma ray test for the presence of radium has been asked for, and
Mr. Berry, counsel for the plaintiffs seems disposed to grant us this
request. Dr. Flinn, together with a registered M. D., will make this
examination, but our lawyers feel that Dr. Flinn's findings should be
checked by someone else competent in this field. It does not seem feasible
for me to take part in this phase of the work and your name was therefore
suggested as one whom we might possibly call upon to assist us in this
matter.
Atpresent this examination has been set for Sunday morning
April 22nd,at 10 o'clock - at which time we should like to have you here
to assist in the above examination.
As previously mentioned our case will not appear on the
docket until April 25th, which means the loss of two days on your part,
although we expect to call Dr. Moore and Dr. Lind in addition to yourself
and would like to have a conference with you three together with our
lawyers and Dr. Flinn at two (2) oclock on April 24th. This conference
will enable our lawyers to ascertain the value which you men will be at
the trial, as well as posting you in/general as to the type of information
they desire to obtain. I realize that this is asking a good deal of
you, and trust that you can arrange your work at Missouri so as to give
us practically the entire week of April 22nd.
The matter of your compensation for services in this work,
we realize should be suggested by you, but in order that there may be no
misunderstanding, I believe it might be well to outline what we have in
mind. We feellthat & fee of $150.00 for the day that you spend at court
together with $100.00 for preliminary preparation, consisting of conferences
to be held on April 24th, and other conferences which our lawyers may call,
would be equitable. For your services on April 22nd, we feel that you
should be entitled to an additional $100.00. of course we to take care
of all expenses connected with your trip to and from New York.
We know that you appreciate that this matter is vital to us, and
we certainly trust that you will feel justified in giving us your time
and assistance in this matter.
