Dear Dr. Fisk:
This will confirm the arrangement made with your Secretary for
your appearance, as 8 witness in our behalf, at the suits against this Corporation
by former employees alleging injuring from redium exposure. These cases are
called for trial Wednesday April 25th, in Newark, before Vice Chanceller Backes.
It will not be necessary for you to appear until Friday February 27th,
and we shall communicate with you giving specific instructions as to the location
of the trial and the probable time of your appearance.
Te hope to establish the following by your testimony:
1. That we cameto you in the early part of 1924, and requested an
examination of our employees. (Mr. H. B. Viedt, our Plant Manager was the one who
interviewed you.)
2. That we talked openly and frankly with you relative to the question
of possible injury to our employees then confronting us, and showed a sincere
desire to find out if there was anything wrong with gaid employees. (It is charged
by the complainants that we dereived and endeavored to suppress information and
facts relating to the condition).
3. That you examined our employees at our request and made a report
on same. A report was prepared and delivered to each employee examined covering
her particular case.
4. That the examinations showed no conditions other than those
commonly found in similar groups of employees in other lines of industry.
5. That at the time of this examination there were no reported cases
in the medical literature of a Jaw necrosis having developed as a result of
operators using luminous material for the painting of watch, clock and similar dials.
The again wish to thank you for your willingness to appear in our
behalf on the above date. We shall be very glad to consider you as an expert
witness, and compensate you accordingly.
