May 3, 1928. RE: FREYER ET AL VS. U.S. RADIUM CORP. #3486-LDF Edward A. Markley, Esq., Collins & Corbin, 1 Exchange Place, Jersey City, II, J. Dear Mr. Markley, Please accept my thanks for your letter of the 2nd inst. enclosing copy of report of Dr. Baker. It seems to me significant that Mrs. Hussman does not show the so-called characteristic bone changes which are said to be present in the other cases. If we could show that Mrs. Hussman had a traumatic fracture of the left femur (and you will recall there is some evi- dence of such a fracture), it might be helpful to us in controverting her claim that she is suffering from radium poisoning. This is of particular importance in her case because even though we win the Chancery action, we will probably be obliged to try her case at law because she claims that her illness did not develop until within two years of the date when she brought her suit. She will undoubtedly claim on this ground that her action is not barred by the Statute. Do you suppose that the investigator who has been working on these cases could May 3, 1928.
