My dear Mr. Lee:
Mr. O'Neill of my office went to see
Vice-Chancellor Backes the other day with a letter from
me declaring our inability to proceed with the cases sooner
than the dates set at the hearing, to wit, September 24th,
25th, 26th and 27th. The Vice-Chancellor told Mr. O'Neill
that the cases had not been advanced, but still were set
down for the dates above mentioned.
I have written Mr. Berry to this effect,
stating that if he had any motion to make in the premises,
he should make it upon notice to us and not ex parte.
