medicine and medical treatment, to a sum which shall not exceed Seven
Thousand Five Hundred Dollars ($7,500.).
4. The party of the first part further agrees to pay for such
reasonable and ordinary future medical treatment for the party of the secord
part as shall be rendered necessary by reason of radium poisoning or the
effects thereof, which treatment and the amount to be paid therefor shall
be approved by the Committee of Physicians hereinafter mentioned, or by
a majority of such Committee.
5. The party of the first part may, at its option, provide and pay
for such extraordinary medical treatments for the purpose of curing the
party of the second part, as may be determined by said Committee of
Physicians hereinafter provided for, or a majority of them, and the party
of the second part hereby agrees to take any such treatments so provided
by the party of the first part.
6. The parties hereto agree that a Committee of Physicians shall
be appointed in the following manner:
(a) On or before the 2nd day of July, 1928, the party of the second
part shall join with the above mentioned CATHERINE SCHAUB, ALBINA LARICE,
and JAMES A LARICE, her husband, QUINTA McDONALD, her husband JAMES
McDONALD, EDNA HUSSMAN and LOUIS HUSSMAN, her husband, in appointing a
physician experienced in the use of radium and its effects on the human
body, and who shall have heretofore neither examined nor treated any of
the persons last above named, for said alleged radium poisoning or the
effects thereof, or been in any way identified with the cases instituted
by such persons against the party of the first part in behalf of any
party to the said cases.
(b) On or before the 2nd day of July, 1928, the party of the first
part shall appoint a physician having the qualifications above mentioned.
(c) The two physicians so appointed under subdivisions (a) and (b)
hereof, shall forthwith agree upon and appoint a third physician having
like qualifications, and in the event that such physicians shall not be
able to agree such third physician shall be appointed by Honorable
William Clark.
(d) In the event that the physician jointly appointed by the persons
named in subdivision (a) hereof shall become incapacitated or resign, the
party of the second part will join with said other person so named in
appointing the seccessor to such physician, and in the event that the
physician appointed by the party of the first part shall become incapic-
itated or resign, the party of the first part shall appoint his successor.
In the event that the physician appointed by such two physicians or by the
Honorable William Clark, as the case may be shall become incapacitated or
resign, such two physicians shall appoint his successor, or in the event
of their failure to agree, a successor shall be appointed by Honorable
Willain Clark.
(7. The party of the first part shall pay the reasonable compensa-
tion and expenses of such Committee of Physicians which, in the case of
disagreement between the members of such Committee and the party of the
first part, shall be fixed by Honorable William Clark.
8. The party of the second part hereby agrees to present herself
for observation, examination and treatment as shall be required by said
Committee of Physicians, or a majority thereof, and to follow out, abide
by the orders, directions and instructions of said Committee or a majority
thereof.
9. It is understood and agreed between the parties hereto, that if
