Re: Canfield vs. U.S. Radium Corp.
My dear Mr. Barker:
Mr. Markley and I appeared before Judge
Mountain today for the purposes of (a) attempting to have
the defense of Statute of Limitations argued in advance of
the trial of the case, and (b) setting a date for the trial
of the case. Mr. Berry appeared for Canfield.
We endeavored to have the Court fix
the trial of the case commencing March 19th. The court
would not do this, but finally set March 10th as the date
of the commencement of the trial. This was done because
in the letter from Professor Lind to you he states he would
be available March 13th-15th. This would give us an appor-
tunity of getting his testimony and the testimony of Prof.
Schlundt who, I understand, could be here with Prof. Lind.
Will you, therefore, please telegraph to
Professors Lind, Schlundt and Moore, stating that the Court
has set the case down for trial commencing March 10th, and
that if they can be here on March 13th to 15th, we think we
can get all of their evidence in, in that period?
I think it would be also wise to have
Professors Lind, Schlundt and Moore here on January 17th,
so that we may have a conference. This conference should
also include you and Mr. Lee. Will you please arrange this
and let me hear from you?
