Dr. Harry H. Bowing,

Rochester, Minn.
Dear Dr. Bowing:
I am writing this second letter, as it may be that you
will wish to use only the one in connection with presenting this matter
to your Board of Governors.
I wish to advise that I discussed this same subject with
Dr. Pohle at Madison, and Drll Rolland H. Stevens of Detroit, and that
both men consented to give us their aid.
Since my return to New York I have discussed the entire
situation with our counsel, and we have tentatively set February 15th,
Saturday, to take these depositions in Chicago. The depositions will
probably be taken under the conditions that should you be available at
the time of trial your testimony before the Court would still be usable.
We appear in the Supreme Court of New Jersey on March
1 th, and in the Federal Court on March 25th, and hope to use your
testimony in both cases.
The testimony would probably be taken at one o'clock
before a clerk at one of the Law offices in Chicago. Our attorneys, as
well as myself, would arrive in Chicago early that morning, and would
hope to have a conference with you around 10 A.M., the exact time and
place to be set later.
As you appreciate the time is rather short before we take
these depositions, but there seemed no later date which was satisfactory,
and we sincerely hope that this time will fit in with your plans.
Re, of course, expect to reimburse you for any expense
connected with this work, as well as for your services.
