March 11th,1930. Globe Indemnity Co., 20 Washingon Place, Newark, N.J. Att'n Mr. Chas. Stockdell Gray Dear Mr. Gray: In accordance with the understanding arrived at in Mr. Smith's office in Jersey City yesterday afternoon, we have this morning sent check to Mr. Smith made to the order of Potter and Berry in the amount of $8000.00, which represents full settlement and satisfaction of the Canfield case against the United States Radium Corporation. It is understood that the New Amsterdam Casualty Company, and the Globe Indemnity Company, will each send us a check for 1/3 of the $8000.00 above mentioned. We wish to go on record that we do not recognize the method of division proposed by Mr. Pesinger, of the New Amsterdam Casualty Company, as an equitable one, and therefore, our contri- buting 1/3 towards the settlement of the above case is in no way to be interpretated as prejudicial to our right to demand contri- butions from the Insurance Companies involved based on coverage.
