Gentlemen: In re: 1-C-517716 Mrs. Ruth Saxer (Nee Ruth
Winters) vs. United States Radium Corporation.
We have your letter of the 26th and duplicate of one written
to the Globe, Indemnity CO., the New Amsterdam Casualty CO.,
and the American Mutual, regarding possible claim by the
above named. We are writing Collins & Corbin suggesting the
advisability of their calling a conference of the various
companies involved together with yourself, to discuss this
case and any other matters relating to the general situation
which may come up. In the meantime we assume you will be able
to ascertain from your records exactly when claimant was employed
by you. This would seem necessary in order that the various
insurance companies interested can determine the question
of coverage. We do not know at the present time whether
claimant was employed during the period our policy was in force,
but we hereby notify you that because of the delay in reporting
the occurrance and the indefiniteness of the whole situation,
we cannot assume your liability unconditionally. We will be
glad to cooperate with the other carriers interested in this
particular matter and advise you at a later date, after available
data has been secured, of our decision regarding an assumption
of a pro-rata share of the costs and expenses.
