June 5th,1930. Mr. G. W. Pesinger, New Amsterdam Casualty Co., 60 John St., N.Y.C. Re: Mrs. Ruth Saxer (nee Ruth Winters) N.YC-46108 Ruth Saxer-nee Ruth Winters VS. Radium Luminous Material Corp. of Del. Dear Mr. Pesinger: As suggested in our conversation of this morning, I herewith confirm the points discussed by letter: Some three or four weeks ago I discussed with Dr. Humphries the condition of one of his patients by the name of Mrs. Ruth Saxer, whom he had been treating, and which he had diagnosed as a "radium poisoning" case. Dr. Humphries feels that Mrs. Baxer has a legitimate case and that she should be compensated. He endeavored to enlist the services of Judge Clark in her behalf, but Judge Clark declined on the ground that there were other radium cases in the Federal Court at the present time. Dr. Humphries then approached the United States Radium Corporation, thru Mr. Markley, with the hope that some satisfactory settlement could be effected without the necessity of Mrs. Saxer resort- ing to litigation. In case Mrs. Saxer cannot obtain redress without going to court, Dr. Humphries feels that she should press her case, and sufficient time has now elapsed that 1t is our opinion unless we take some steps to show that we are disposed to at least consider effecting a settlement, suit will be shortly instituted. As suggested, we believe that electroscopic tests should be conducted and that there should probably be taken a testimonal examing- tion to ascertain more facts relative to when Mrs. Saxer first suffered pain which might have been attributed to "radium poisoning", and other pertinent data. According to my understanding you approve of making the electroscopic tests and are willing to beareyour proportionate share of the expense involved - also any other expense involved for physical examination, etc. It is probable that Dr. Schlundt will be in New York some time the latter part of next week or the forepart of the week following, and Mrs. Saxer should be examined during his visit, which would not entail as much expense as if it were necessary to bring him on for this one case. I expect to have a conference with Mr. Emory and Markley to determine the exact technique to be involved, and will advise you as to the result of this conference.
