October 27th,1930. Dr. Herman Schlundt, University Of Missouri, Columbia, Mo. Dear Dr. Schlundt: I talked with Mr. Markley this morning and found that the counsel for lirs. liets had declinéd to extend to us the courtesy of & re-exasination - that is electroscopic. It is, however, Messrs Markley and Smith's intention to present this matter to the Court to endeavor to get the Court's order. This case is scheduled for the November term, and I presume we will have definite word with regard to this the early part of the month. We probably will not go to triel until late in the month, if in November at all, due to the fact that it will be necessary to impanel a Struck Jury, which always consumes some time. In the event that we are successful in obtaining a re-exsmination it is my opinion that it will be on the expired air only, and that we will have to collect urs. Meta's expired air at her home, and to make the test at such a place as we deem advisable. We cannot depend upon having any cooperation in this work. Sincerely yours, Vice President.
