Barker United States Radium Corporation 535 Pearl Street New York City Dear Barker: I have your letter in regard to the cases which you expect to come up in New York on January 5. I think that Dr. Moore's hesitancy and mine about making appointments to come to New York for these cases has been on account of the uncertainty of the engagement rather than on account of actual time put in in preparation, correspondence, etc. I think you understand the situation that the necessary dates must be kept clear and that late notification of cancellation is sometimes quite awkward. For example, if other appointments are made on the same trip which cannot be cancelled, it leaves things rather hanging in air. This is what Dr. Moore and I had in mind with reference to retainer fees as a sort of insurance. Of course, if Dr. Moore comes on to New York for treatment, and his recovery is sufficiently rapid, he might still be able to serve you. I doubt, however, if his condition will justify this, or if you would want to put him on the stand, as it might create an impression unfavorable to your case. I still hope, therefore, to be able to serve you if he is not, and if the necessity arises. It would necessitate, however, that I would either be away continuously for nearly two weeks, or that I would have to make two trips East in successive weeks. If you happen to get a postpone- ment to some later date, it would appear much more convenient for me, but I know that you have many other things to consider. With best regards, Sincerely yours, s.
