Dear Dr. Lind:
The status of the Metz and Tuck cases vs. United
States Radium Corp., trial date of which has been set for
January 5,1931, is as follows:
Negotiations are under way for settling the Tuck
case, and we don't believe but that this will go thru prior to
trial - as I previously advised you we consider this a legitimate
radium case. The Metz case, however, we do not feel to be a radium
case, and we have every intention at the moment of going to trial
in this instance.
We would like to have you available a3 an expert
witness during the week of January 5th, but could probably arrange
to take your testimony on either the 7th of January or the 8th,
probably the 7th. Under these conditions you would have to be
available on these two days only.
We recognize the inconvenience that night arise should
you make arrangements to testify on this date, and at the last
moment postponement of the trial would arise - a matter which might
be entirely beyond our control. We are therefore willing to make
a definite arrangement with you for thèse dates, and in the event
the case is either settled or postponed we would be glad to honor
your bill for professional services in such amount as you would deem
equitable.
