accrue until thare is a conurrence of wrongful act and a resultant injury, both which together connote a legal in- juria. In this case, the lady did not sustain any phys- ical injury, the deleterious substances remaining in her body, capable of producing injury; which condition remain- ed latent, unobserved and unobservable, until about six months before the commencement of the action. The other element, defendant's fraud, either by the suggestio falsi or suppressio veri, would of itself be sufficient to postpone the operation of the statute of limitations, were it not true that the statute of itself does not operate until the actual concurrence of a wrong and a resultant injury occurs. For these reasons, defendant's several pleas of the statute of limitations, should be stricken from its answer, or disregarded upon the trial. Dated, February 20, 1931. JOHN WINANS Attorney of and of Counsel with Plaintiffs Metz.
